Dear Tauranga Boys' College,
I hope this letter finds you well. I am writing to request access to certain information under the provisions of the Local Government Official Information and Meetings Act 1987 (LGOIMA).
Specifically, I am seeking copies of the minutes and agendas of the last 24 school board meetings held at Tauranga Boys' College.
I request that the information be provided in electronic format.
I understand that, under the LGOIMA, you are required to respond to my request as soon as reasonably practicable and no later than 20 working days from the date of receipt.
If any part of my request is to be declined, I request that you provide reasons for the refusal as stipulated by the Act.
Should you require any further clarification or details to process this request, please do not hesitate to reply.

Yes, what you’re missing is that schools are only subject to Part 7 of LGOIMA, not the rest of it. They are listed in Schedule 2 of the Act, not Schedule 1. The process relating to meeting minutes set out in Part 7 is in section 51, and is very specific. It involves physically going to their office, looking at the minutes, and asking for a copy if you want one.
Outside of this process, your option is to make a request under the OIA, to which schools are subject in full. However under the OIA they may request you to prove your identify.

The statement that the request is under LGOIMA because it concerns meeting minutes is nonsense. Schools are not subject to LGOIMA as they are not part of local government. They are part of the Crown, and as such are subject to the OIA. The school is quite entitled to ask you to prove your eligibility to seek information under the OIA.
