Tēnā koe Tauranga Boys' College,

Under the Official Information Act 1982 I am requesting information regarding the recent prefect voting. Specifically, I am seeking a detailed breakdown of the voting results conducted this year, including the precise number of votes received by each candidate (along with their names), categorised by student and staff votes.

After careful consideration of the potential reasons for withholding official information as outlined in Section 9(2), I find none of these reasons applicable. The anonymity of voters will be safeguarded, and participants in the prefect selection process are aware that their names are not subject to a confidentiality obligation.

Refusing information under Section 9(2) is contingent upon a public interest test as per Section 9(1). In my assessment, the following points support the release of this information:

1. A substantial portion of the College community, encompassing voters, staff, students, and nominees, has actively participated in the process.

2. Transparency in the release of voting results would foster confidence in the school and its democratic processes.

3. Enhancing democracy by creating an environment that upholds human rights and fundamental freedoms, ensuring the freely expressed will of the people is exercised.

4. Increased engagement in the process and heightened awareness of the democratic proceedings.

5. Upholding integrity and accountability by promoting transparency in the voting process.

I would like to draw attention to Student Board Elections, which align with the principles supporting my request. Under the Education (Board Elections) Regulations 2000, returning officers are mandated to declare the results of those elections.

Please find a copy of our Prefect selection policy attached.

As you will see from our current policy, this is an ‘application’ and a
‘selection’ process not an ‘election’ process. 

We had 81 students apply to be prefects in 2024 and at this stage 24
students have been selected.

Staff and students feedback is gathered via a google form- perhaps the
word ‘voting’ is misleading as this is not an election. This feedback
allows staff/students to provide feedback and refer students they believe
would be suitable for this role and is used as part of the selection
process. 

This process is more like a job application:

* Students apply. 
* Staff/Students act as referees. 
* Interviews take place with potentail condidates for the role. 
* Appointments are made. 

In this scenario, it is not appropriate to share the information of the
applicants with other applicants or anyone else. 

We therefore would not be willing to share this information as we
believe it is private and confidential. We have a duty to protect the
privacy of individuals. 

We certainly provide feedback to any students seeking why their
application was not successful.
