4. Please provide all communications around the 2020 UFBA investigation into the UFBA CEO.

As noted in our response letter we are seeking clarification on question 4
of your request:

 

“Please provide all communications around the 2020 UFBA investigation into
the UFBA CEO”

 

All communications to do with the UFBA investigation into the UFBA CEO
when searched for currently captures a large amount of information. In
order to respond to you as soon as possible, can you please consider
providing a more refined request and clarification for what exactly you
are requesting. If there is a more specific time period your request
covers, certain individuals or a type of communication, can you please
provide this information.

 

A response as soon as possible would be appreciated so we can move forward
with this part of your request.

Dear Official Information Requests,

With respect to point 3, I ask you to reconsider your refusal reason as it does not appear to be appropriate. I asked for “all information”, yet you appear to have attempted the recharacterise the wording of my request to “formal advice”. This is not what I asked. Obviously, official information includes information that is known to an agency but may not be written down. This information is clearly known to FENZ, clearly exists (and can be found), and is clearly official information as it was provided to FENZ by PWC, at FENZ’s request, and is discussed by FENZ with the FENZ board with some of this information minuted in the FENZ board minutes. Where a public organisation like FENZ engages a professional accounting company to answer a question, that is clearly official information – whether it's in a terms of reference or not.

In regard to point 4, please provide me all information from August and September 2020.

Dear Official Information Requests,

Thank you for the information you provided. However, there appears to be some information missing.

1. Sid Wellik emails Brendan Nally apparently about the UFBA investigation on 17 August; however, Sid is a FENZ employee so must have been informed about the UFBA investigation by the UFBA at some point. Could you please provide the information from the UFBA to Sid that must have predated Sid's 17 August email to Brendan?

2. The UFBA letter to FENZ of 18 Feb 2021 that you provided refers to an 11 Feb 2021 letter from Swain to the UFBA about an audit of the UFBA and questions around the appropriateness of Tangata Matatau. Please provide this letter.

3. You provided an 18 Feb 2021 email to Swain (presumably from the UFBA Board, although this information was redacted) in response to Swain’s 11 Feb 2021 letter. This letter states, “The UFBA CEO will address the points you raise about Tangata Matatau separately in his response to correspondence received today from Rhys Jones.”
a) Could you please provide this information (apparently a 18 Feb 2021 letter from Jones to UFBA/Bill Butzbach mentioning Tangata Matatau).
b) Could you please also provide UFBA CEO Butzbach’s response that is referred to here.
