Dear QLDC Services,
Further to this aspect of the request where you stated:
“As is normal on much of Council reserve land, premise and structures can occupy land for a
peppercorn occupation of $1 per annum. QLDC does not own the building.”
The agreement provided earlier as part of this request states that QLDC does own the building. However the other parties had occupation rights, provided members of the public could book the hut.
It appears that no member has been able to book this hut for over 25 years.
You again mention meeting with the relevant parties, given the relevant parties have been deceased for over 12 months I am curious as to how this meeting eventuated? It would explain why there has been no correspondence with the parties. Is it possible to get a transcript of the discussion, presumably this was via way of a priest or some other connection to the after life.
The agreement states that the hut will revert to public management upon the death of the two parties; as this has now been over 12 months has the management of this hut reverted to public management?
If not, why not? And when will this occur.

Can you please advise when the meeting with representatives of the deceased estate took place, and advise the time frame in which personal items were to be removed by.
Could you also please advise what steps have been undertaken in working with the family for the removal of personal items and building compliance checks?
Can you also please advise how the meeting was organised and who attended the meeting. It seems as though the meeting must have been organised by telephone or in person as there is no correspondence between the two parties. Given this must be the case could you please advise what conflict of interest was registered. If there was no conflict of interest registered could you please advise why not.
It seems highly improbable that there has been no correspondence between to the two parties pertaining to the meeting and the subsequent return of the management to the QLDC.
As such if this information, or a satisfactory response, is not received in a timely manner I will have to ask the Ombudsman to follow the matter up.

Dear Information Request,
I would prefer all correspondence to be public. These should not be complicated requests.
It seems as though QLDC is intentionally withholding information, or has not done what they are supposed to have done.
To date you have advised that the Hut is owned by QLDC, that the Hut is privately owned, that there has been a meeting with the relevant parties, despite them being deceased, that there has been no correspondence with said parties in relation to the meeting, or subsequent follow up.
From the information provided the Hut was supposed to be made available for the public to book (despite no record of any booking system), the management of the Hut was supposed to revert to the QLDC over 12 months ago. It seems as though the QLDC is in breach of the Reserves Act, as per the emails provided previously and has been for over 25 years.
It is difficult to believe that there has been no correspondence regarding the Hut both internally, or externally, that there have been no notes taken, despite a meeting occurring which set out an unknown process for the Hut to revert to QLDC management - noting that this was to occur over 12 months ago.
As such please advise:
The date of the meeting with the relevant parties
The people, or positions, of QLDC representatives who attended the meeting
How the meeting was organised
The outcomes, including time frames for removal of personal items, and time frames for the Hut to revert to QLDC management
Please also provide a copy of all correspondence pertaining to the Hut both internally, and externally.
Please note that recollections of other correspondence, including telephone calls, and other conversations, are subject to the Local Government Official Information and Meetings Act.

discuss and crystalize the next steps of withdrawing their occupation.

Further to this. Taking information to the executive would also constitute internal communication.
It is also highly unlikely that no notes or minutes were taken from the meeting in order to take information to the executive.
This shouldn’t be so difficult.
This information is public information and is all subject to the Local Government Official Information and Meetings Act.
Whilst I accept not providing names for the people who attended the meeting I requested the names OR the positions of the people who attended. A generic response of ‘The Property Team’ does not fulfill this part of the request.
It seems, as earlier suggested, that QLDC is attempting to withhold information.
As such if a satisfactory response to this OIA is not received by close of business Monday 11th of July 2022 I will request that the Ombudsman take a look at these ongoing and repeated breaches of your legal responsibilities.

In addition we got the updated contact details from the hut's window signage and the meeting was organised by phone followed by an Outlook invite and there wasn't any correspondence attached to the invite.
We can confirm again that there were no meeting minutes, phone records or notes taken for this meeting.

To clarify; despite saying previously that you needed to get support from the Executive for the proposal to work with the family of the deceased to remove items; nothing has been written to the Executive, nor were any notes of the meeting recorded, even though the follow up meeting is in two weeks where the Council’s decision on this matter will be outlined?
It doesn’t appear that the Council knows who owns the building, despite the agreement stating that Council owns the building. Has this been clarified?
There has been no correspondence both internally or externally relating to the illegal occupation of the hut for over 25 years, despite Council being made aware of the illegal occupation in early 2022?
The council has received $1 a year for the illegal private occupation, but there is no record of any money changing hands. It is normal in these examples for an invoice to be issued (this would
also constitute correspondence).
You were made aware of the death of the original occupiers, but this just occurred miraculously?
You became aware in early 2022 about the illegal occupation but to date, other than a meeting, which confirmed the hut management would be returned to Council, even though no notes or minutes were recorded you’ve done nothing about this illegal occupation?
You’ve said that you offered me a meeting, despite there being no offer of a meeting being made.
And all this information has had to be extracted with great complication.
A meeting invite (and response) constitutes correspondence. My initial request asked for copies of ALL correspondence.
Presumably there has also been a secondary meeting invite.
Has QLDC done everything that should have done in this scenario?

Dear Queenstown-Lakes District Council,
Could you please advise why there are contradictory statements within the OIA regarding the meeting, and the information provided relating to what was discussed at the meeting contained within the OIA regarding conversations pertaining to the original OIA?
Specifically regarding future occupation, gas, bookings, and management?
This would indicate that there was a lot more discussed at the meeting with the deceased parties family than what you have indicated.
You will note that recollections of meetings are subject to LGOIMA as well as written correspondence.
It seems as though you are intentionally withholding information.
As this request was made well outside the statutory 20 working days I would appreciate an urgent response regarding this matter.
