Dear Queenstown-Lakes District Council,

Is there an agreement between QLDC and Auckland International Airport Limited or its subsidiary (AIAL), which governs the management and operation of Queenstown Airport Corporation Limited (QAC) and the relationship between QLDC and AIAL?

If so, does that agreement contain a list of matters that require the consent of (1) both QLDC and AIAL as shareholders or (2) the affirmative vote of the AIAL appointed director?

If so, please provide a copy of the agreement.

If you decline to provide a copy of the agreement, please provide a redacted copy of the agreement, removing any supposedly commercially sensitive information.

If you decline to provide a redacted of the agreement, please provide a copy of all of the provisions of the agreement that require the consent of (1) both QLDC and AIAL as shareholders or (2) the affirmative vote of the AIAL appointed director.

More interestingly, you appear to have the time to quibble over response times, when instead you could simply have provided the information requested.

response and our internal staff are now reviewing some of the

Dear Information Request,

Your reply is disappointing because of the deliberate delay in replying, and the spurious explanation regarding the need for more time for supposed consultation.

None of this enhances the standing of the Council in the eyes of its ratepayers. Nor does it re-establish the ratepayers’ trust in the Council.

Please reply in substance immediately.

Dear Information Request,

As a follow up to my letter of yesterday, it appears now that the Council is in breach of the LGOIMA in that it failed to provide the information I requested within the 20 working days. Your explanation that you did not receive my request until 26 August is patently wrong, as your office acknowledged receipt on 25 August.

This means therefore that it is too late to extend the date for replying in substance to my request. Any such extension would have had to be made within the 20 working days, not afterwards. It follows from that, that QLDC must provide the information immediately to avoid continuing to breach the LGOIMA.

Aside from that, you have (or more likely the chief executive of QLDC has) indicated that consultation is needed before information can be released. Your office did, however, receive a similar request for related information in mid-May, which you eventually declined to provide on the grounds of commercial sensitivity.

My request was for much more limited information and was drafted to make it easier for you to decide which part of the requested information you could release.

Given this and the fact that you have already had a similar request, it beggars belief and credibility to now say that you need another month to engage in consultation. Your office has had plenty of time already and does not need any more time.

Having regard to these circumstances, your 20 working day extension is not reasonable, as per section 14(2) of the LGOIMA.

I therefore reiterate my request for QLDC to provide an immediate substantive reply to my original request for information.

I will also refer this matter to the Ombudsman.
