(b) All information on which the information requested in 1(a) was based including but not limited to any risk and/or impact assessments in relation to the risk and impact on the surrounding community and the impact on traffic flows from pedestrians and cyclists crossing Maunganui Road at ground level, the impact of the decision on NZTA’s focus on creating accessible ‘liveable communities’, alternatives that were considered other than removing the underpass from the project, reports, background documents, correspondence and other communications which informed the information in 1(a); and
(c) All information provided to decision-makers in relation to the 2018 decision to retain the Bayfair underpass from the Baylink project including but not limited to any change requests, memos, reports, and background documents (or equivalent) on which the decision was based.
2. As the underpass is due to be closed within a weeks, and the decision has only recently been made public, I request the information be provided as a matter of urgency under s12(3) OIA.
3. I note that as the decision referred to in 1(a) was made so recently, this information should be available almost immediately and the information in 1(b) should also be readily available. I am happy to receive the information in tranches for the sake of urgency.

Dear Hon Phil Twyford,
Thank you for your partial response to my OIA request of 16 August 2019.
I note that information has been redacted from your response under s 9(2)(f)(iv) to maintain constitutional conventions. My understanding of this ground for redacting information is that it is generally used to provide a decision-maker time and/or space to make their decision.
As the Ministerial Briefing Note to you is dated 9 August 2019 and the decision to remove the underpass from the Bayfair to Baypark project was publicised by NZTA on 8 July 2019 via a media release, this is clearly not the reason for withholding this information.
Please immediately release the redacted information or provide details of the grounds supporting why the information has been redacted under s 9(2)(f)(iv). I note that there is significant public interest in this information as the removal of this key infrastructure will impact:
- all vehicle users of the Bayfair roundabout during construction of the project;
- all vehicle users of the Bayfair roundabout (as opposed to the flyover) on completion of the project;
- all pedestrian and cycle users of the current underpass including many school children and mobility impaired pedestrians;
- businesses (both retail and industrial) in Owens Place.

Thank you for your response regarding the NZ Transport Agency's decision
to extend the length of time required to complete your request for
information under the Official Information Act 1982.

Thank you for your partial response to my OIA request of 16 August 2019.
I note that information has been redacted from your response under s 9(2)(f)(iv) to maintain constitutional conventions. My understanding of this ground for redacting information is that it is generally used to provide a decision-maker time and/or space to make their decision.
As the Ministerial Briefing Note to you is dated 9 August 2019 and the decision to remove the underpass from the Bayfair to Baypark project was publicised by NZTA on 8 July 2019 via a media release, this is clearly not the reason for withholding this information.
Please immediately release the redacted information or provide details of the grounds supporting why the information has been redacted under s 9(2)(f)(iv). I note that there is significant public interest in this information as the removal of this key infrastructure will impact:
- all vehicle users of the Bayfair roundabout during construction of the project;
- all vehicle users of the Bayfair roundabout (as opposed to the flyover) on completion of the project;
- all pedestrian and cycle users of the current underpass including many school children and mobility impaired pedestrians;
- businesses (both retail and industrial) in Owens Place.

(a)All information provided to you in relation to the recent decision to remove the Bayfair underpass from the scope of the Baylink project including but not limited to any change requests, memos, reports, and background documents (or equivalent) on which the decision was based; (b)All information on which the information requested in 1(a) was based including but not limited to any risk and/or impact assessments in relation to the risk and impact on the surrounding community and the impact on traffic flows from pedestrians and cyclists crossing Maunganui Road at ground level, the impact of the decision on NZTA’s focus on creating accessible ‘liveable communities’, alternatives that were considered other than removing the underpass from the project, reports, background documents, correspondence and other communications which informed the information in 1(a); and (c)All information provided to decision-makers in relation to the 2018 decision to retain the Bayfair underpass from the Baylink project including but not limited to any change requests, memos, reports, and background documents (or equivalent) on which the decision was based.
2.As the underpass is due to be closed within a weeks, and the decision has only recently been made public, I request the information be provided as a matter of urgency under s12(3) OIA.
3.I note that as the decision referred to in 1(a) was made so recently, this information should be available almost immediately and the information in 1(b) should also be readily available. I am happy to receive the information in tranches for the sake of urgency.”

Thank you for your response of 25 September 2019. It appears that some information may have been accidentally omitted from your response. Can you please urgently provide the following:
1. Email from John McCarthy to Andrew Thackwray and Darryl Coalter dated 13 June 2019 (attachment 9) refers to Darryl briefing Andrew but I cannot see any information that appears to be this briefing – can you please either advise which attachment contains the information that was conveyed in this briefing or provide the information to me.
2. Email from John McCarthy to Andrew Thackwray and Darryl Coalter dated 13 June 2019 (attach 9) also refers to a memo prepared by John McCarthy and Darryl (Coalter?) that was attached to the email. From the email trail it appears Andrew requested amendments to the memo that were actioned by John. Can you please confirm if this is the memo from John McCarthy to Andrew Thackwray and Darryl Coalter dated 21 June 2019 which was included as attachment 9? If not, please urgently provide a coy of the memo referred to in the email.
3. Updated underpass user figures – Baylink Scope Variation MGI active mode recommendation 19 September 2018 (attach 7) is the only document I could see that contains user figures for the existing infrastructure. This document identifies both the significant increase in users of the underpass from previous figures and that there was high density housing under construction in Owens Place (on the Matapihi side of the intersection) at the time the recommendation was written. Can you please direct me to where the updated user counts and projections are for the underpass?
4. Updated vehicle traffic modelling based on the updated underpass user numbers referred to in 3. above – as increased numbers of active users through this intersection will have a direct impact on vehicle users of the intersection this modelling is key to understanding the impact of the decision to remove the underpass on traffic flows and therefore on the aspect of the project that does not relate to active users.
5. Safety audit of the intersection for the period immediately following removal of the underpass until completion of the project, ie during the ‘temporary traffic light’ solution.

I note that the information request above is not an additional request, it is information that should have been supplied as part of the response provided to me on 25 September 2019 and is now overdue. Please provide this immediately.

Can you please also urgently confirm that the email conversation in attachment 9 is the actual decision to remove the underpass from project scope? In particular Andrew Thackwray’s email of 25 June 2019 to John McCarthy and Sarah Downs where he asks “Can I take it we all agree the underpass is no longer an option…” and Sarah Downs’ subsequent email to Darryl Coalter of 26 June 2019 stating she is happy for the contractor to be informed of the decision. If this is not the decision, please direct me to which attachment contains evidence of the decision.

Thank you for your response of 1 October 2019. Your response is unacceptable for the following reasons:

1. You state that the memo dated 21 June 2019 (attachment 8) is the memo referred to in John McCarthy’s email of 24 June 2019 and is also the briefing referred to in John McCarthy’s email of 13 June 2019 as having already happened. This is clearly not possible as the briefing had already occurred before Mr McCarthy emailed Mr Thackwray. YOUR ACTION: Provide the information that was contained in the briefing from Darryl to Andrew or on which that briefing was based.

2. You appear to be treating the other items I requested (3 – updated underpass user figures; 4 – updated vehicle traffic modelling based on the updated underpass user numbers; and 5 – safety audit of the intersection in the period immediately following removal of the underpass) as new requests under the OIA to which a new 20 working day period would apply. My original request which was transferred to NZTA on 22 August clearly requested “any risk and/or impact assessments in relation to the risk and impact on the surrounding community and the impact on traffic flows from the pedestrians and cyclists crossing Maunganui Road at ground level… reports, background documents, correspondence and other communications which informed the decision”. The information requested in items 3, 4 and 5 of my correspondence of 30 September 2019 fits within that request and is now significantly overdue. YOUR ACTION: Provide the information referred to in this paragraph urgently.

The destruction of the underpass is now imminent and all of the information requested above is now overdue. Please respond to this request urgently.

Dear Priscilia Gain,

Please advise on what grounds the information referred to in my reply of 30 September (3 – updated underpass user figures; 4 – updated vehicle traffic modelling based on the updated underpass user numbers; and 5 – safety audit of the intersection in the period immediately following removal of the underpass) does not fall within the scope of my initial request? If it is excluded because it was not in existence at the time of the decision or was not considered in making the decision, please state this in your response. Otherwise, the information appears to fall squarely within the original request and as such is now significantly overdue. Please supply a response immediately.

Thank you for your response of 1 October 2019. Your response is 
unacceptable for the following reasons:

 

 

 

1.            You state that the memo dated 21 June 2019 (attachment 8)
is  the memo referred to in John McCarthy’s email of 24 June 2019 and is
also  the briefing referred to in John McCarthy’s email of 13 June 2019
as  having already happened. This is clearly not possible as the briefing
had  already occurred before Mr McCarthy emailed Mr Thackwray. YOUR
ACTION:

Provide the information that was contained in the briefing from Darryl to 
Andrew or on which that briefing was based.

 

 

 

2.            You appear to be treating the other items I requested (3 – 
updated underpass user figures; 4 – updated vehicle traffic modelling 
based on the updated underpass user numbers; and 5 – safety audit of the 
intersection in the period immediately following removal of the
underpass)  as new requests under the OIA to which a new 20 working day
period would  apply. My original request which was transferred to NZTA on
22 August  clearly requested “any risk and/or impact assessments in
relation to the  risk and impact on the surrounding community and the
impact on traffic  flows from the pedestrians and cyclists crossing
Maunganui Road at ground  level… reports, background documents,
correspondence and other  communications which informed the decision”. The
information requested in  items 3, 4 and 5 of my correspondence of 30
September 2019 fits within  that request and is now significantly overdue.
YOUR ACTION: Provide the  information referred to in this paragraph
urgently.

 

 

 

The destruction of the underpass is now imminent and all of the 
information requested above is now overdue. Please respond to this
request  urgently.
