Council staff have reviewed your request and would like to advise that the
request has been refused under section 17(f) of LGOIMA on the basis that
the information requested cannot be made available without substantial
collation or research.

 

Council is required under Section 17B of LGOIMA to provide you with the
opportunity to refine your request. 

 

Section 17A of LGOIMA allows Council to charge a fee for the collation and
redacting of commercial or private information from the documents. 

 

Council’s charges (as per Council’s Fees and Charges 2023-24) for
responding to LGOIMA requests is as follows:

 

Requiring less than 30 minutes of No charge
staff time
Requiring in excess of 30 minutes First hour no charge.  $38 per half hour
of staff time of part thereof thereafter.

Photocopying or other charges may apply.

 

These fees are as per the Office of the Ombudsman guidelines. 

 

If staff believe the request will take longer than 60 minutes, then the
requester will be notified of the likely and maximum time and cost
involved.  Council staff have estimated that there is a minimum of 8 hours
work involved to collate, review and redact private and commercial
information.

 

Could you please advise if you would like to proceed with your request and
pay a fee, refine your request or accept our refusal?
