Dear New Zealand Transport Agency,
The Ngā Ūranga to Pito-One section of Te Ara Tupua has made significant progress and is under construction. An online search, specifically including the NZTA Te Ara Tupua website, reveals very limited information on the project.
The following information is requested for the Ngā Ūranga to Pito-One section of Te Ara Tupua:
PROJECT GOVERNANCE
Please provide the names of the persons assigned to the following (or equivalent) roles:
• Project Sponsor
• Project Director
• Project Manager
• Lead Designer
The request for names includes any that are not NZTA staff.
PROJECT DRAWING LIST
Please provide the drawing list for the project. For each drawing, a drawing list would normally include at least the following information:
• Drawing Number
• Drawing Revision
• Revision Date
• Title/Description
• Status: eg Draft/Checked Out/Approved for Construction/ etc
• Designer Name
• Approver Name
The request for names includes any that are not NZTA staff.
SAFETY-IN-DESIGN REGISTER
Please provide the current version of the Safety-in-Design register for the Ngā Ūranga to Pito-One project.
DESIGN SAFETY AUDITS
Please provide all road safety audits and design safety reviews completed to date.
PLAN VIEW
Information requested includes:
• drawings showing a plan view to the limits of the project
• all drawing layers and,
• all layers kept separate and preserved.
The information requested includes measurement of any selected:
• distance,
• area and,
• angle.
ACCEPTABLE FILE FORMATS
The files provided must be suitable to read/view with a CAD viewer, compatible with file types:
• DXF
• DWG
OR
• The drawings requested may be hosted on a website and viewable via the Internet.
If drawings are accessible from the Internet, the website must include functions to measure any selected:
• distance,
• area and,
• angle.
The website must include a function to select drawing layers to view or hide.
PRINTED HARD COPY or PDF FILES ARE NOT ACCEPTABLE because they cannot provide all of the information requested.
CROSS SECTIONS
Information requested includes drawings showing typical cross-sections of the cycle way at the following locations:
• The Rail Over-Bridge (not at the viewing area),
• Gravel beaches including the 1.8m chain link fence and the 1.2m ecological screen,
• Gravel beach including the 1.8m chain link fence and the 1.8m ecological screen,
• Rock revetment including the 1.8m chain link fence.
It is acceptable for these cross-section drawings to be pdf files if the drawings include a scale or dimensions.
CYCLE WAY MARKINGS
Inspection of the on-line artists impressions (eg. Tahataharoa) include painted markings that are likely to be interpreted as demarcation between cyclist and pedestrian “lanes”. If the drawings already requested do not include details of the painted markings then:
Please provide details of the painted road markings, specifically including the widths of the “lanes”.

be able to provide you with the Health and Safety in Design (HSID)
Register and Road Safety Audit – Consenting Stage for the Ngâ Ûranga to
Pito-One section of Te Ara Tupua by Friday, 3 February 2023.
Unfortunately, further time is required to prepare these documents for
release. Waka Kotahi will endeavour to provide the documents to you by
Friday 10 February 2023 and will keep you updated should any further
delays arise.

Dear Mark Kinvig
Thank you for your update 25 Jan 2023 to the related request for information.
My request included the names of the persons assigned to leading roles in the project. In your response you stated "I am withholding the identities of external contractors under section 9(2)(a) of the Act." Your reliance on this section of the Act is not consistent with the Act or the Ombudsmans' guidance. Neither the Act or Guidance define or refer to “external contractors”
The Ombudsman "Guide: Names and contact details of public sector employees" includes the advice:
“The Ombudsman’s general position is that there is usually no basis for withholding staff names if all that would be revealed is what they did in their official capacity—‘New Zealand does not have a tradition of an anonymous public service’ .”
And
“While this guide refers to ‘public sector employees’, meaning employees of Ministers and agencies subject to the OIA or LGOIMA, it is also relevant to public sector contractors who are individuals.”
My request for the names of the persons assigned to leading roles in the project remains extant.
