From: Darren Conway
Dear James Sorenson
I am confused by your last response dated 13 July 2023. The letter includes the statements:
"I have made a decision to grant your request for the Health and Safety in Design Register, Design
Safety Audits and Assessments and Meeting minutes involving safety aspects of the project. ... We wil[l] release these documents ... on or before 29 September 2023."
and also:
"I am withholding your request for design Safety Audits and Assessments under section 9(2)(g)(i)."
I would like to point out that safety of cycling/pedestrian facilities has very high public interest and any reasonable person would expect crystal clear transparency of safety risks and their treatment. I am not asking for draft notes. I am seeking the current versions of safety related documents. In addition, consultants are paid and expected to provide free and frank opinions as part of any documents they may have produced. Given the importance of safety in this project, it is difficult to perceive how free and frank discussion could be impeded by the release of the information requested to an extent that exceeded public interest.
Yours sincerely,
Darren Conway

Dear Darren,
Thank you for your email relating to our response to your request.
We apologise for the error in our wording. We would like to clarify that
we have made a decision to release to you, information relating to the
following three aspects of your request:
o Health & Safety in Design Register
o Design Reviews
o Meeting minutes involving safety aspects.
The repetition of the Design Safety Audits and Assessments aspect of your
request was unintentional. We are withholding that part of your request
for the time being. As we said in our response to you, it is essential
that during the audit and assessment process, the staff involved, from
multiple agencies, are able to express their opinions in a free and frank
way, in order to ensure a robust and safe design is arrived upon.
We understand your keen interest in the safety of the project and its
design. It is our view that withholding the information for the time
being, while it is undergoing an audit and assessment process, is in the
public interest. However, this is inherently time-limited so a future
request for the information would be considered on its merits at the time
it is received.
We remain open to engaging with you in relation to the project and
facilitating any requests or questions you might have.
Kind regards
Ministerial Services
