On 29 January 2020 the Prime Minister announced the $12 billion New Zealand Upgrade Programme, which includes $1.354 billion to build a 21.5km, four-lane road corridor from Manukau to Drury, running parallel to State Highway 1 (Mill Road).

In accordance with s 12 of the Official Information Act 1982, please provide any information, reports or advice considered by the Government, in deciding to fund and build Mill Road, in respect of:

1. The increased greenhouse gas emissions that will result from the construction and operation of Mill Road;
2. How Mill Road will impact New Zealand’s ability to meet the 2050 target for the reduction of greenhouse gas emissions under s 5Q of the Climate Change Response Act 2002;
3. How Mill Road will impact New Zealand’s ability to meet its international obligations in respect of climate change, including under the Paris Agreement;
4. Whether and how Mill Road will give effect to the Government’s objectives, recorded in the Government Policy Statement on Land Transport 2018, of:
a) reducing greenhouse gas emissions from transport; and
b) increasing mode shift from private vehicle trips to walking, cycling and public transport;
5. Whether and how Mill Road will give effect to the Government’s road safety strategy and plan, Road to Zero, adopted in December 2019; and
6. The views of Auckland Council, including Auckland Council’s declaration of a climate emergency on 11 June 2019.

In any case, given NZTA’s public indication that it intends to lodge a consent application for the southern section of the project in early 2021, please now treat the request as urgent, and provide the information sought within 10 working days, i.e. by Tuesday 2 February 2021.

I note that the request is relatively confined, and that any relevant information the Government relied upon in making the decision to fund the Mill Road project ought to be readily identifiable. Providing the information by 2 February 2021 should therefore be straightforward.

The request is for information, reports and advice (relating to the specific matters identified in the request) that Cabinet considered in making the decision (announced on 29 January 2020) to fund and build Mill Road.

To the extent relevant reports and advice are held by the New Zealand Transport Agency or other agencies, I am content to receive copies from those agencies.

That will not fully resolve my request, however, which also seeks information about what members of Cabinet actually considered in making the funding decision. Regardless of whether other agencies hold relevant reports or advice, the question of what Cabinet considered is a matter that only Cabinet can answer.

I therefore require a specific response on behalf Cabinet. The response needs to address directly whether Cabinet gave specific consideration to any information, reports or advice in relation to the matters identified in the request. The response should also include any documents recording Cabinet’s reasons for the funding decision.

The request is for information, reports and advice (relating to the
specific matters identified in the request) that Cabinet considered in
making the decision (announced on 29 January 2020) to fund and build Mill
Road.

 

To the extent relevant reports and advice are held by the New Zealand
Transport Agency or other agencies, I am content to receive copies from
those agencies.

 

That will not fully resolve my request, however, which also seeks
information about what members of Cabinet actually considered in making
the funding decision.  Regardless of whether other agencies hold relevant
reports or advice, the question of what Cabinet considered is a matter
that only Cabinet can answer.

 

I therefore require a specific response on behalf Cabinet.  The response
needs to address directly whether Cabinet gave specific consideration to
any information, reports or advice in relation to the matters identified
in the request.   The response should also include any documents recording
Cabinet’s reasons for the funding decision.
