Dear Ann Evans,

Thankyou for the response. Do you have a legal reason for withholding held copies of the "Situation Report", or was the failure to include them an oversight?

If providing everything from 2014-2018 is likely to be substantial collation and research", I am happy to only receive copies from the last two years. In anticipation of a claim that the information is commercially sensitive and can be withheld under s9(2)(b)(ii), I argue that if the information is provided for free it cannot be considered "commercial". If withholding under s9(2)(ba)(i) is considered, I note that the Ombudsman's guidance makes it clear that there must be an actual obligation of confidence, and that insofar as the reports contain information publicly available elsewhere (e.g. published in newspapers), that material can not be considered "confidential".
