Hello Mr Vollebregt,
 
Thank you for your information request as below, and for the request you
also sent directly to the Council.
 
I have spoken with the Council officers best places to advise on your
request and have received the following is response:
 
Where anyone wants maps of properties in the same ownership, they should
use the publically available LINZ Data Service. It is necessary to
register for the service, if personal data like customer names are wanted,
but it is free.
 
We do not provide public access to maps of Council properties as there is
no definitive map. Council staff can see a layer of data but it includes
privately owned properties that the Council maintain, and land that the
Council used to own and has sold. The requested information is not
currently available without analysis to extract parts of the data.
 
Council does not own railway corridors. It owns roads but we do not show
these as Council owned on our maps, because everyone knows we own them.
Showing ownership of maps is also difficult when there are properties
where we are an owner of part of a property, so wrong to imply we are the
total owner. In many cases, we will technically be the owner, but a
private person or company will have a long term registered lease which may
mean we will have no control for decades.

Hello Thomas,

Further to your last question, I spoke again with the Manager Property, and the Team Leader Land , Customer & Property Information.

The Council owned property is not held in a central database, as assets are owned and operated by multiple business units across the Council.

To collate this information would require going out to each Business Unit and asking for them to compile lists that reflect those assets owned and controlled by the unit. As such, your request for information is refused on the ground that the list requested does not exist, and would have to be created.

I am sorry, but I cannot be of further assistance at this time.

I would note that the WCC response is not very satisfactory because, although WCC property may be operated by different business units, I do not believe that a WCC Business Unit can own council property unless it is a Council Controlled Organisation such as wholly owned Wellington Cable Car Ltd (http://wellington.govt.nz/your-council/c...) or other seperate legal entity.

I would have expected the WCC to have at least outlined its points on difficulties with sourcing the information and then invite the requester to further refine their request. The WCC could also have offered:
* to provide a list of the properties held on its main council property register noting that there are other properties not on this the register.
* provide a list of the properties registered on the LINZ DB to the WCC
* provided a list of the council organisations that own WCC properties so the requester can progress their request with them on an individual basis.

The request now has the latter path which is to ask for a list of all WCC business units and then ask each WCC Business Unit for the information that is obviously not held centrally.
