Request for Adopted Gender Position Paper & Related Clarification

Dear KingsWay School and Board of Trustees,

I note in the minutes for the Board of Trustees meeting on 12th August 2024 that a paper "NZCPT's Gender Position Statement" is introduced. It was then adopted as the KingsWay School Boards official position in the meeting on 23rd September 2024.

I am kindly requesting:

1. The statement mentioned in the August meeting notes, 6.1 NZCPT Gender Position Statement and Guidance, “NZCPT Gender Position Statement”

2. Any policies and procedures proposed or introduced from this position as mentioned in the August meeting notes, 6.1 NZCPT Gender Position Statement and Guidance, “The Proprietor requests that the KWS Board adopts the gender position statement and then work out their policy and procedures using this document.”

3. Any documentation of the consultation with the school community in regards to proposed or introduced procedures as referred to within the response to my first OIA request as received on 15 May 2025, “...should the KingsWay School Board choose to adopt it, then any proposed school policies formed from it would go through a process of consultation with the school community before any ratification or publication.”

4. Clarification on if "NZCPT's Gender Position Statement" supersedes “KWT Gender Position Paper” for the purposes of a KIngsWay School gender position statement. I am seeking to understand if the "NZCPT" statement has replaced the "KWT" statement as I note that in response to my last request you stated, “The KingsWay Trust (...) presented this paper to KingsWay School Board for feedback from KingsWay School Board and officers and employees of the school and that process has not yet finalised.”

Kia ora Sarah,

We refer to your 22 May 2025 Official Information Act 1982 (“Act”) information request regarding the “NZCPT Gender Position Statement” and specifically your request for:

We have considered your request and part of the information you have requested is enclosed, however, we are declining request 1 for the NZCPT Gender Position Statement mentioned in the KingsWay School Board meeting minutes on 12 August 2024 under section 18(d) on the grounds that the information will be publicly available soon. NZCPT have advised the Board that they will be publicly publishing their position paper in a transparent and accessible manner on their website in Term 3, 2025. We will notify you when they have done so.

In response to your requests 2 and 3, we are declining your request under section 18(e) of the OIA as the information does not exist at this time. This is because the KingsWay School Board is yet to begin both the process of creating policies and procedures in relation to this paper and the process of consultation with staff and the school community in relation to any resulting policies and procedures. The process of consultation with relevant stakeholders and the school community is intended to commence in the latter part of 2025. As part of our policy development process in relation to this paper, any policies or guiding statements adopted by the Board that impact the school community will be made available via official channels following appropriate consultation and ratification.

In regard to your fourth and final request for clarification as to whether the “NZCPT Gender Position Statement” supersedes the “KWT Gender Position Paper” for the purposes of a KingsWay School gender position statement, whilst the KingsWay School Board has adopted the NZCPT Gender Position Paper, both papers still form part of the overall consideration by the Board of this matter until the process of drafting policies and procedures and engaging in consultation with staff and the school community in relation to this matter has concluded.
