I refer to your request to the Ministry of Education by email of 24
October 2025, at 10:36 am, requesting certain information, namely:

 

 1. All emails between me, principal Denise Horley of Sandspit Road School
and the board of trustees presiding member  Kylie Windelburn regarding
bullying and violent incidents; and
 2. The data into the number of bullying and violent incident reports for
this school with any outcomes if possible.

 

As the Ministry has advised you, it transferred your request to Sandspit
Road School on 4 November 2025 in accordance with section 14 of the
Official Information Act 1982 (the OIA).

 

The school has collated the emails covered by the first element of your
request and reviewed the nature and content of the information comprised
in those emails. The emails contain information provided by or about
individual students and parents disclosure of which, without their consent
to release you, would infringe their privacy. You have not identified any
connection between yourself and students at the school and their parents
that suggests you have any authorisation to seek access to personal
information about them. Disclosure of emails containing personal
information about other individuals to you in these circumstances would be
equivalent to disclosure to the world at large.

 

After taking independent legal advice on the application of the OIA, we
consider that making available copies of the emails would prejudice the
interest protected under section 9(2)(a) of the OIA which permits the
school to refuse a request for information to protect the privacy of
identifiable individuals. In the circumstances of this case, simple
redaction of names would not be sufficient to protect the privacy of the
persons concerned. However, pursuant to section 16(1)(e) of the OIA, we
can prepare a summary statement that makes available information about the
fact of complaints having been received about alleged bullying and violent
incidents involving students and the response of the school and board to
those complaints which does not infringe the privacy of individual
students and parents.

 

In respect of the second element of your request, this statistical data
and information about broad outcomes will be incorporated into our
proposed summary statement under section 16(1)(e) of the OIA. The Ministry
of Education advised Sandspit Road.

 

We note that your request was received by the school on 4 November 2025 so
the maximum time limit for response under the OIA is 2 December 2025. If
we need to extend the maximum time limit for response beyond that date we
will advise you accordingly pursuant to section 15A of the OIA.

16(1)(e) of the OIA, we have prepared and attached a summary statement
that makes available information about the fact of complaints having been
received about alleged bullying and violent incidents involving students
and the response of the school and board to those complaints which does
not infringe the privacy of individual students and parents. 
We note that your request was received by the school on 4 November 2025 so
the maximum time limit for response under the OIA is 2 December 2025. We
have completed this request today, 30 November 2025. We now consider this
closed.
