My apologies it is late. We have had to consult with Armourguard.

 

My colleague is assisting now with the LGOIMAs I was mamaging as I have
moved into a new role. Once she is back from leave (tomorrow) we will
address your outstanding requests.

Apologies for my delay in responding to you. 

 

Staff have been consulting with a third party regarding the release of the
contract/agreement. Unfortunately this is taking longer than anticipated,
I acknowledge that we have not responded to your request in the timeframe
as set out in the Local Government Official Information and Meetings Act
1987 (LGOIMA). My apologies for this, you have the right to request the
Ombudsman to investigate and review. Complaints can be sent by email to

We are hoping to hear from the third party early next week and I will

Dear Gypsy,

Some 86 days have elapsed since I first made this request. It is now long overdue and well outside of the LGOIMA’s legislated timeframe.

Note that while the Act does in fact permit you to advise that you will need an extension, you did not do so which means that the law may have been broken in this circumstance. This is a disappointing result which further erodes residents trust in CCC.

Given the delay, which you have indicated relates to consultations, I am concerned that is only taking so long as to determine how to redact significant portions of the documents. Accordingly, I have now referred this to the Ombudsman for further investigation.

I refer to your request we received on 15 November 2021. You requested the
following information under the Local Government Official Information and
Meetings Act 1987 (LGOIMA): 

 

"The Noise Control operations manual (or similar) and the agreement(s)
with any contracted provider(s), such as Armourguard, for the provision &
delivery of these services".

 

I acknowledge that we are well over the timeframe for a response as set
out in the LGOIMA, unfortunately it took longer than anticipated to
consult with a third party and with staff absentees we were unable to get
this to you sooner.

 

Please find attached the noise control procedures between CCC and
Armourguard. This is the relevant section of the contract that constitutes
the Noise Control operations manual (or similar) and the agreement(s) with
any contracted provider(s), such as Armourguard, for the provision &
delivery of these services.

 

You have the right to seek an investigation and review by the Ombudsman of
this decision. Information about how to make a complaint is available at
[2]www.ombudsman.parliament.nz or freephone 0800 802 602.

 

I hope this assists, however please let me know if you have any further
questions. Once again my apologies for for the delay.
