Please supply the legislation you have relied upon which you believe allows you to close:

* playgrounds; and
* Botanic Gardens; and
* car parks within parks

during Covid-19 lockdowns.

Note the “COVID-19 Public Health Response (Alert Level Requirements) Order (No 9) 2021” expressly permits “limited recreation purposes” as “essential personal movement”.

This section of the order also permits people to drive places for limited recreation purposes, yet you have closed the car parked within parks.

Good morning Cody,

 

The Christchurch City Council’s actions in closing carparks with parks was one borne simply out of
public safety and health concerns, namely, the Council would find it difficult to enforce the 2
metre distancing rule within the confines of those carparks during Levels 3 and 4..

 

The Botanic Gardens were again closed due to public safety and health concerns for both staff that
maintained the gardens and the general public using the facility. Further, due to the facilities
popularity there were concerns about the ability to control the numbers visiting the facilities and
the ability to maintain social distancing. The social distancing aspect was a particular concern due
to members of the public inclination to stop and ask questions of gardeners. Any inconvenience
caused by the closure of the Botanic Gardens during Levels 3 and 4 was considered by the Council to
be off-set by the close proximity of Hagley Park to the Gardens which was considered more suited to
being an exercise/walking recreational area.

 

The playgrounds were closed at Level 3 and 4 due to the direction that “At Alert Level 3,
playgrounds are closed” – refer to the link to the following website -

While the website makes no reference to playgrounds in Level 4 the presumption was that if
playgrounds are required to be closed during Level 3 that requirement would equally apply in Level
4.
