Dear South Waikato District Council,

For the purposes of this OIA, my name is Mr. Walker, a New Zealand citizen residing here.

I request information in regards to today's stuff article titled "Council still won't have a bar of bar's beam".

In this article, it is brought to the attention of the general news-reading public, that John Anderson, environmental health officer, would not act on the recommendations of MPI if they allowed the beam in the bar. Does the council support his statement made, and if so, do they encourage council staff to operate ultra vires?

Kerry Fabrie has been quoted in the article as saying: "In this case, there are various reasons why the officer has chosen not to use discretion and has advised MPI accordingly. It is not appropriate that the council detail these concerns through the media,". As someone who isn't involved in the media, and is concerned with how the council has acted in this instance, I request that the reasons the officer has not used discretion (possibly a personal vendetta, or personal objection on bars opening up?) be outlined, detailing the concerns which would not be given to the media and your reasoning behind such.

Thank you for contacting Council.

 

In response to your query:

·         To clarify the issue of 'discretion' - there is none in this
case. Under the Food Hygiene Regulations, Schedule 1 (Requirements for
registration of premises), clause 4 (ceilings b), it states under 'All
trusses shall be completely enclosed'. Council cannot register a premises
if the premise does not comply with Schedule 1. So that is what our
Officer is requiring. It is our job to follow the legislation.

·         Council staff are delegated authority to carry out their duties
according to the law. Council supports its staff to act in accordance with
the law.
