Data on Parking Infringement issued for parking on Off Roadway No Parking Zone

Renoh Chalakkal made this Official Information request to Auckland Transport

The request was successful.

From: Renoh Chalakkal

Dear Auckland Transport,

I am writing to request further information regarding an infringement notice I recently received for parking in an "off-roadway no parking" zone, which carried a penalty of $100 NZD.

Upon reviewing the New Zealand Road Code and the Land Transport (Road User) Rule 2004, Part 6.4(1c) – "Parked in a prohibited area" – it appears that this offence is more appropriately associated with a $70 infringement. I also referred to Auckland Transport’s website, where Rule 4 under this legislation lists the penalty as $70.

To clarify and better understand the basis of the infringement, I would like to request the following information:

Under the Official Information Act 1982, I would also like to request the following data:

1. Could you please direct me to the specific section of the Auckland Transport website or relevant policy document that outlines the $100 infringement amount applicable to parking in an “off-roadway no parking” zone?

2. The number of infringements issued by Auckland Transport for "off-roadway no parking" offences where the berm where the parking is not permitted is not maintained by Auckland Council or Auckland Transport, with the specific infringement amounts issued in such cases across Auckland over the past two years.

Thank you for your time and assistance. I look forward to your response.

Yours faithfully,
Renoh Chalakkal
