Dear Auckland Transport,

I am writing to request information under the Official Information Act 1982 regarding an infringement notice I received (Notice #9026240732), which relates to briefly entering a bus lane while turning left from Broadway into Clovernook Road to access Westfield Newmarket.

I would appreciate your clarification and response to the following:

1. Turning Access Clarification:
Could you please confirm what legal and safe options are available for drivers turning left from Broadway into Clovernook Road, given the adjacent lane is marked for straight-through traffic only? How can a driver make this turn without briefly entering the bus lane?

2. Infringement Statistics:
• How many infringement notices have been issued at this specific location (Broadway turning left into Clovernook Rd) in the past two calendar years (2024 and 2025 to date)?
• How many of these notices were issued to drivers who entered the bus lane briefly for the purpose of turning left?
• What is the total amount collected in fines from this location during that period?

3. Bus Lane Signage and Clarity:
Are there any plans to improve signage, road markings, or road layout at this intersection to make it clearer for drivers whether a left turn is permitted and how it should be executed safely?

4. Camera Calibration and Review Process:
• How frequently are enforcement cameras in this location tested or calibrated?
• What is the process for verifying or manually reviewing footage before a fine is issued?

5. Consideration for Local Access:
Has Auckland Transport conducted any assessment or considered whether this enforcement approach might discourage access to local businesses, including Westfield Newmarket? If so, could you please share those findings or reports?

6. Discretion and Context in Infringements:
Under what circumstances does Auckland Transport consider exercising discretion or withdrawing an infringement notice for brief, low-risk bus lane entry made solely for turning into a legal destination?

This request is made in good faith and with an interest in ensuring both compliance and clarity around the use of bus lanes for safe navigation to local destinations.
