Dear Far North District Council,

I would like to know how much debt the Council is in. I request evidence of this debt, namely all documents pertaining to income, expenditure, profit, loss, showing where rate payers rates are going.

I want a written confirmation that my property and other tax payers properties are not being held in security for any Council generated debt. That the Council has no legal rights to obtain rate payers properties to pay debt they have accrued now or in the future.

Thank you for your official information request to the Far North District
Council (‘FNDC’) received on 11^th April 2025. Your request has been
considered in accordance with the provisions of the Local Government
Official Information and Meetings Act 1987 (the ‘LGOIMA’).

 

Your request

“I would like to know how much debt the Council is in. I request evidence
of this debt, namely all documents pertaining to income, expenditure,
profit, loss, showing where rate payers rates are going.

I want a written confirmation that my property and other tax payers
properties are not being held in security for any Council generated debt.
That the Council has no legal rights to obtain rate payers properties to
pay debt they have accrued now or in the future.”

FNDC’s response

Financial information regarding FNDC debt is contained within FNDC’s
Annual Report for the relevant financial year. The information is publicly
available, being published on FNDC’s website. For ease of reference, I
have provided a link to the Annual Report for year end 30 June 2024 as
follows:  [2]FNDC-Annual-Report-2024.pdf (FNDC’s Annual Report 2024 – 25
will be publicly available, once the current financial year has ended and
the Annual Report audited and adopted.)

 

So, in respect of FNDC’s debt for the 2024 – 25 financial year, FNDC is
not yet in a position to provide this information to you and therefore
relies upon Section 17(e) of the LGOIMA – that is, “that the document
alleged to contain the information requested does not exist, or despite
reasonable efforts to locate it, cannot be found”.

 

FNDC confirms that FNDC’s debt is not secured by ratepayer properties.
This is not to be confused with FNDC’s ability to make mortgage demands
for unpaid rates in accordance with section 62 of the Local Government
Rating Act 2002 Please refer to the following link [3]Local Government

rates if owner in default – New Zealand Legislation

 

FNDC also refers you to its publicly available Long-Term Plan 2024-27. For
ease of reference, this can be accessed at the following link

-       Page 95 contains details on securities on borrowing; and

-       Page 208 to 224 – Revenue and Financing Policy provides
information on how FNDC funds operating and capital expenditure as per the
Local Government Act 2002 (‘LGA’).
