I am receipt of your letter dated 10 March 2025
It is a typical Police type response and I will deal with it in paragraph order
1)You say (i)You are refusing the request under 18(da) of the Act etc. etc. 18Refusal of requests
A request made in accordance with section 12 may be refused only for 1 or more of the following reasons, namely:
:(da)that the request is made by a defendant or a person acting on behalf of a defendant and is—
(i)for information that could be sought by the defendant under the Criminal Disclosure Act 2008; or
(ii)for information that could be sought by the defendant under that Act and that has been disclosed to, or withheld from, the defendant under that Act:
First of all, according to YOU, I am NOT the defendant The defendant and the driver at the time, according to YOU, is clearly "PAIHIA TAXIS & TOURS LIMITED," as stated in the original Infringement Notice, Reminder Notice and Notice of Court Hearing. The section says "(da)that the request is made by a defendant or a person acting on behalf of a defendant" Since I am not a defendant and not, therefore, acting on behalf of a defendant this is not, therefore, a ground for refusal to provide the information
You also say that "you have already directed your questions towards Police Prosecutions" This is correct. I directed them to PPS Kaikohe and I have never even received an acknowledgement never mind a reply and haven't the faintest idea who the prosecutor is..

The disclosure package duly arrived in October and at the bottom of the letter it said "Any further correspondence on this matter should be address to:-

It is now March 12th. 2024 and I STILL do not know who is the "Officer in charge-NZ Police" How about that for foot dragging?
I visited Kaikohe Police station on 14th. October 2024 and served papers on them stating that there was no case to answer under Section 147 Criminal Procedure Act 2011 because of the breach of statutory obligation-failing to provide initial disclosure. Police have failed to meet their legal obligation under the Criminal Disclosure Act. No reply, not even an acknowledgement. I also served a copy on the Kaikohe District Court.
I visited Kaikohe Police station again on 27 November 2024 and served a request for Full Disclosure. I had already e mailed it to [email address] I had written to Mr. Rahui on a number of occasions and have never received a single acknowledgement never mind a reply.
I eventually got really ticked of and phoned your head office. I actually made FOUR phone calls, all of which were recorded. In the firs 2 I was told that if I gave my name and e mail address copies of the calls would be sent, of course, nothing arrived. In the 3rd and 4th calls I was told that what I had been told in the first 2 was incorrect and that I would have to provide ID in order to get the recordings I did this at Kerikeri police station. I am now being given the run around by Josh - JJXY51 Information Request Analyst. I am still waiting See email below

During the first phone call I was actually put through to Kaikohe Police station and actually spoke to a prosecutor who was noy cooperative and actually hung up on me. He told me his name but I didn't write it down. I imagine that Jos-JJXY51 is dragging the chain to prevent me getting the prosecutor's name.
I have now written a hard copy letter to your Minister who has also failed to reply to my 4 e mails about this
There is a whole lot more to this but I will end here for now and see what I get back this time
