Dear New Zealand Transport Agency,

In 2017/2018 RDC received grant funds from MBIE to shift a chip seal road onto road reserve as asphalt. Applications for funding state that two options were presented, one that required the moving of power poles, and another creating a safer T shaped intersection onto SH49. It states that NZTA was instrumental in the final design option chosen.

1./ Copy(s) of the funding application(s) for the work upgrading of Teitei Drive

2./ Copy of the independent Engineer’s certification (including design basis) to
demonstrate that the design meets the appropriate recognised roading
standard to cater for the road catchment

3./ Copy of the works contract documents

4./ Copy of the independent Engineer’s certification (including associated field
loggings etc) of each stage of the construction works

5./ Copy of NZTA’s consent to the design, location and work’s completion of the
intersection with SH49

6 ./ Copy of any correspondence, notes and the like between NZTA and third
party(s) including RDC and within NZTA regarding the following:

a) Any consents permitting the encroachment of the Teitei Drive outside of
the designated public road at the intersection with SH49,

b) Any consents granted to permit the construction of the carpark and toilets
within the Gazetted Recreation Reserve,

c) Any consideration that the works located within Ohakune Domain comply,
or not comply, with the provisions of the Reserves Act,

d) Any “relaxing” of acceptable, recognised road design standards for Teitei Drive to not cater for the potential usage of this public road, ie. 150 residential lots plus the Ohakune Domain usage.”

Dear Official Correspondence,

The communications relate to Ruapehu district council and their contractors upgrading the teitei drive intersection with sh49. The intersection and road was constructed around 2018 and formed illegally by encroaching on Rockford park which council have now admitted to. Ghd and council documents show statements that “nzta was instrumental” in the solution.

When council went to consultation with 4 options to which the 4th option shows a clear design encroaching on Rockford/carrot park but did not disclose the illegal activity.

Council have conveniently misplaced or cannot locate any approvals, compliance, discussions or communications regarding the project to which we have formally made a complaint to the ombudsman. The ombudsman has ruled in our favor on a number of complaints over the last year where council has failed to release information.

Council also documents they nzta provided some funding towards the project, but most funding was provided by MBIE. Documents and funding applications to MBIE contain false declarations and information, a common occurrence we have seen from RDC with funding applications and communications of late. Nzta even picked up on some of the antics by RDC recently where the proposed teitie drive subdivision was claiming to be within specification and to provide to the district rules and plans; and then nzta found they in fact not providing the necessary car parks or road widths etc that were claimed in the consent application, to which nzta provided conditional approvals.

We look forward to your documentation and communications with regards to the approvals and communications on the intersection and how “nzta was instrumental” in its design or approval. We wish to see any compliance documentation and approval for the change to the state highway, something you should have records for your network and to provide funding for.

Sorry for the extended delay in responding.

The project was funded from the Regional Mid-sized Tourism Fund from Central Government,
Ruapehu District Council and a contribution from NZTA for approval of the intersection upgrade. A

Ruapehu District council meeting minutes from Meeting Date: 2 March 2017 state
5.2.2 The carpark will have a new safer access road from Rangataua Road (SH49) built to
NZTA requirements constructed onto existing road reserve.

5.3.5 Should Council’s funding application be successful but not for the full value applied for,
other funding options to cover the shortfall are available as follows:
(b) The intersection with SH49 may also qualify for funding assistance from NZTA
through its State Highway minor improvements work category.

Furthermore, in the mentioned LGOIMA 000055.pdf on page 20-23, all 4 concepts are shown, with concept 4 showing a clear breach & encroachment to a national reserve / park. The Intersections soul purpose was not for entry to the carrot park, but to service properties along Teitei Drive, and was being built to service a larger lot with up to 154 houses. From page 24 through 36, options decided, all involved concept 4 which was the illegal encroaching concept. Page 45 then shows "The intersection with State Highway 49 may qualify for funding from NZTA through their State Highway Minor Improvements category of work." as "Other Funding".

On page 54, meeting minutes (from 27 June 2017) between GHD & RDC mention "To 30th June - Won't get all work completed and budget spent by 30 June, resource needed on EW. Update 27/06/17 - Forcast looking to balance with NZTA", it is not understood if this relates to Teitei, but is being provided to assist with your search.

On page 55 however, it does specifically specify "Ohakune Carrot Intersection & Carpark Improvement - Funding application successful! $655k MBIE, $150k Council, $30k NZTA" so the $30k funding from NZTA should be a little easier to locate in your systems and to understand how this was approved and what the funding was allocated for, and whether concept drawings were provided to NZTA and or approved by NZTA, or if any comments, requirements or communications.
