information relating to 6 Teitei Drive, Ohakune. Your request was:

“As you may be well aware, the development at 6 Teitei Drive, Ohakune has
seen hundreds of rate payers in Ohakune very upset with the secrecy, lack
of transparency, the gifting of a rate payer asset, the lack of
communication or consultation surrounding the development.

We are collecting all resources and information for our members and ask
that you please provide:

external to any parties between 2021 and today”

Te Tûâpapa Kura Kâinga - Ministry of Housing and Urban Development has
completed an initial search for this request and has identified a number
of documents within scope.  We are also currently drafting a response to
your recent correspondence, that you will receive a response to shortly.

Thank you for your email of 13 December 2023, regarding the Ministry of
Housing and Urban Development’s (the Ministry’s) response to your recent
Official Information Act 1982 (the Act) request. We have also received
your two letters regarding Teitei Drive (the Project), and you can expect
a full response to these in January 2024. However, we can provide you with
a timeline of events now, which we hope you will find useful.

On 9 November 2023 you requested:
“All emails, documents, drafts, applications, notes, minutes,
communications regarding 6 Teitei Drive, Ohakune both internal to the
Ministry and external to any parties between 2021 and today”

On 20 November 2023 you refined your request to:
"In response to your question for information required or requested,
please provide a total count of items that you have identified within
scope, if you can provide a summary of the document type and count for
each that would be great. i.e. 53 documents, 100 emails, 23 meeting
minutes".

On the 13 December 2023 The Ministry provided you with a response to the
refined request. If a request is amended or clarified after it is made, it
can be treated as a new request which replaces the original one, under
section 15(1AA) of the Act. The Ministry has fulfilled its obligations in
responding to your refined request.

Teitei Drive Project information and timeline

Following local body elections in 2019, Ruapehu District Council (RDC)
identified housing as a key need for the district and developed objectives
to address housing supply and affordability issues.

The Project is a multi-stage development on 9.5ha of residentially zoned
RDC-owned land in Ohakune. Stage 1 will focus on building houses on 44
lots to address acute local housing challenges. The Project will be
delivered via a partnership between Ruapehu District Council, Ngâti Rangi
and Kâinga Ora to develop 44 dwellings, comprising a combination of social
housing, market price-capped housing stock and houses designated for
long-term rental accommodation for local residents. Stage 2 – 3 comprises
90 build ready sections to be developed by RDC.

There are two parts to Stage 1 of the Project: 

* Land development to provide 44 individual, serviced and ready to build
lots. 
* House construction to delivery of 44 homes comprising 15 social
houses, 15 affordable homes and 14 worker-rental homes under a
separate sale and development agreement with RDC. The social houses
will be retained by Kâinga Ora – Homes and Communities.

Land Development

On 21 December 2021, the Infrastructure Reference Group Ministers approved
the release of $5.2 million in Crown funds to the Ministry and Kâinga Ora
– Homes and Communities as a grant for the Land Development of the
Project. In consultation with Crown Infrastructure Partners, the Ministry
and Kâinga Ora – Homes and Communities have negotiated a standalone shovel
ready funding agreement. The primary role of Kâinga Ora – Homes and
Communities is to be the Government’s delivery agent for the Land
Development of the Project. The $5.2m in funding is being distributed and
managed by the Ministry. 

On 4 April 2023, the standalone funding agreement was signed between
Kâinga Ora – Homes and Communities and the Ministry for the land
development. The total funding available to be paid by the Ministry under
and on the terms of this agreement is up to $5.2m plus GST (if any).
Kâinga Ora – Homes and Communities is required to fund all other costs
(including any and all cost overruns and any funding shortfall) required
to complete the land development of the Project. RDC will provide $2.3m of
co-funding for the land development of the Project. 

Stage 1 of the Project is a greenfield site with no current infrastructure
within the site boundary. The funding will provide infrastructure such as
electricity, Chorus, stormwater, wastewater and water supply connections
to deliver 44 build-ready lots.

House Construction

Kâinga Ora – Homes and Communities will enable the delivery of 44 homes
comprising 15 social houses, 15 affordable homes and 14 worker-rental
homes under a separate sale and development agreement with RDC. The public
homes will be retained by Kâinga Ora – Homes and Communities. The Ministry
is not a party to the house construction part of the project. Any house
construction questions will need to be directed to Kâinga Ora – Homes and
Communities or RDC.

If you wish to make further requests under the Act, please consider the
respective involvement of the Ministry and Kâinga Ora in the Project.

Section 14 of the Act is a mandatory transfer requirement in circumstances
where the person dealing with the request has a genuine belief that the
information is either held by another agency, or more closely connected
with another agency's functions. 

This request is more closely connected with the functions of Kâinga Ora,
and as Kâinga Ora is best placed to answer part of the request, you can
expect a response from them to questions 2, 3 and 7 in due course.

Thank you for your request, partially transferred from the Ministry of
Housing and Urban Development, for information under the Official
Information Act 1982 (OIA):     

o 2./ On 4th April an agreement was signed between HUD & KO for $5.2m,
the next month this was increased (at KO expense). We have sighted
emails between May - July 2023 stating the figure had ballooned to
$7.5m which KO would fund by "selling houses". Please provide copies
of emails or documents that relate to this change and any discussions
around them between this same time frame.
o 3./ On 4th August 2023, we discovered a Conflict of Interest (COI)
between a Project Lead, Giles Tait, who owns a property via Trust that
neighbours stage 1 of the project, It was stated a verbal COI was
given when he joined in October, but he only registered an official
COI in on 7th August after written parliamentary questions and media
questioning. The contract between HUD & KO has provisions for
registering conflicts, please provide copies dates and conflicts
registered against the project.                 
o 7./ While funding and all communications talks about 44 lots, 46
residential lots have been applied for. Please provide documentation
or emails relating to the use or ownership of the additional two
residential
lots.

 Dear OIA Requests,

Thank you for your response.

As HUD is party and author to the contract, one would expect the contract
enforcement would be actioned by HUD and Kāinga Ora would not be left to
act freely without consequence.

Nonetheless, I request the following information in accordance with the
agreement points set out below, that HUD should have on record internally
due to the term requiring KO is to Notify HUD.

I ask the following questions in relation to information received by HUD
from Kāinga Ora as part of the agreement wording for Teitei Drive.

TRANSFER TO KO

2./ Point 3.7 - Has KO notified HUD of any Changes to 3.7(a) or 3.7(b)

3./ Point 3.8 - please provide me with the reports to date received by HUD

4./ Point 3.10(a) - regarding conflicts of interest. Please provide any
communication or records, that HUD holds where Kāinga Ora has notified HUD

5./ Point 3.10(b) - KO will promptly notify HUD of any matter that could
have an adverse affect on the project or result in Termination. Please
provide any communications received by HUD matching this criteria

6./ Point 3.11 - please advise if KO have advised HUD of any breach of
this term, or if HUD has given any warnings or cautions to KO.

7./ Point 3.15 -  Management of COI's - Please provide documentation and
emails provided to HUD about the conflict of interest relating to Giles
Tait and whether HUD signed off or closed the matter off to "HUD's
satisfaction"

8./ Point 3.17 - We note from KO OI 23 714 that KO & HUD were to meet in
September 2023 - Has Kāinga Ora requested any time extensions to
milestones, and if so please provide a copy and documentation related and
whether they were approved or not.

10./ Point 5.2(d) - In addition to question 6 above, Do any phone calls,
texts, emails or documents exist around this point since 1 July 2023, i.e.
around extensions, or of termination due to non compliance.

13./ Please provide a copy and date of the email or document from Kāinga
Ora (OR CIP) to HUD stating the project will exceed $5.2m total cost, we
already have a copy of the email sent to CIP and the meeting minutes from
the DPM's where this was discussed a month after contract signing; we are
wanting the date and communications where HUD was notified.

HUD WILL RESPOND TO 1,9, 11, 12, 14 and 15.

1./ Point 1 (Funding), please provide a list of payments to KO made to
date and supporting documentation used to approve payment, also include
the amount paid and dates

9./ Point 4.1, 4.2,4.3 - Have HUD requested any items under 4.1, please
provide copies; also has HUD assigned an observer, or document any
discussions under 4.3 of the agreement.

11./ Point 6.1 - We have provided evidence as to a breach of the
Warranties, where KO has provided CIP/HUD misleading (emails from senior
staff stating to withhold facts from ministers and reference group to
obtain funding) and providing false statements on the funding application
(stating the consent to be simple and permitted, when it was in breach of
just about every district rule and policy) and that funding was well
understated and known at time of application to then be increased by $2.3m
just a month after contract signing. Please provide emails & documentation
into the investigation of these breaches that have been reported and the
status of the investigation.

12./ Point 9 - Please provide any communications received by HUD in
relation to media enquiries and the responses made by HUD.

14./ While this is somewhat opinion while we await OIA response (which has
been delayed and extended, due for response this week), it would appear
Teitei Drive/State Highway intersection encroaches a reserve/park, thus is
not legally formed; 6 Teitei Drive has no legal access. To go through
formal consultation with the community on vesting this park land as road
could take years, or the reconstruction of the road to form on the correct
location will be costly and take time. The consequences to the whole
development and any resource consent application could be interesting.
Please advise if HUD has received any communications about provide any
documentation or emails that relate.

15./ Has HUD been notified that the partners to the 6 Teitei Drive project
have been put on notice and a Judicial Review is likely, please provide
copies of communications or documents as this should be covered under
question 2 above

We have set this out, so your agency is fully aware of the situation it
now finds itself in. We have members who have agreed to support a judicial
review application covering all steps associated with RDC’s & KO
involvement with this agreement and in particular the resource consents.
We leave open at this stage whether as a matter of prudence or law your
agency may have to also be named as a defendant.

We note that should such an application for Judicial review become
necessary and an urgent injunction sought to stop all consideration until
the hearing is held then we will be seeking indemnity costs against RDC –
leaving open any claim against your agency.
