13/10/23 In the email to Renee on the 16th June 2023, a red line was redacted and related to the statement around 44 homes. We have been enquiring about the remaining 2 lots as there are actually 46 lots being developed for residential.

Please provide the un redacted copy of the statement as it is clearly hiding the point of the additional 2 lots.
Please provide all information and documents and emails that relate to the 45th and 46th lots.
These were acknowledged in our letter to you of 19 October 2023 (sent to
your personal email), which acknowledged these requests and several
others. We advised you that we are treating these additional requests as
one request, and notified you of an extension of time to make our
decision, to 28 March 2024. If we can respond sooner, we will do so.
We advised you that in accordance with section 15A(1)(a) of the Act, this
extension is necessary because your request necessitates a search through
a large quantity of information and meeting the original time limit would
unreasonably interfere with our operations. You have the right to seek an
investigation and review by the Ombudsman of this decision. Information
about how to make a complaint is available at
[2]www.ombudsman.parliament.nz or freephone 0800 802 602.

Dear Kainga Ora Correspondence,
I do not accept the aggregating of requests into a single OIA and the extension of time until march 2024. Many of these questions the information is readily available and should be responded to in a timely manner.
Thus I request each OIA is dealt with on an individual basis and responded to individually to their respective threads.
As has been seen in previous followups where Kainga Ora has responded on an aggregated basis, questions have gone unanswered and missed.
Yours sincerely,
Barry Murphy
From: Barry Murphy
Dear Kainga Ora Correspondence,
I remind you that this OIA is unanswered and we do not agree to the aggregation of OIA requests.
The request should be responded to on the email address it was received from.
The requests were not from a single person, but from a number of people (on behalf); some unable to use computers due to their age or impairment, so the treatment is unjust and unfair.
You are very aware I am acting for over 150+ residents and ratepayers, and this is proven by the recent Society incorporation.
Yours sincerely,
Barry Murphy

received on 18 July 2023. We are considering the other 19 requests under
the terms of the Official Information Act. If you are dissatisfied with
the responses you have received or with our handling of your requests then
you may make a formal complaint to the Ombudsman on each of the points you
are dissatisfied with.
Through your requests you have the information that is available on this
development. Much of this information is now accessible online for all
members of the public to review at [1]Teitei Drive :: Kāinga Ora – Homes
and Communities (kaingaora.govt.nz).
In the future, we will not respond to further emails, such as these seven
received on 14 November, which express your opinion and do not constitute
new requests for official information as defined under the terms of the
Act.

Dear Kainga Ora Correspondence,
I ask you to reconsider; MSD tried to use the same excuse to release information such as the number of people on the waiting list and the number and count of people in the families etc. The ombudsman found this was not warranted.
We ask you to please re-consider before Friday 14th, else we will be lodging a complaint with the ombudsman.
Yours sincerely,
Barry Murphy

Dear Mr Murphy
As mentioned in our response to you dated 12 June 2024, we elected not
provide you with the full survey results in order to protect the privacy
of all of the respondents to the survey.
The advice of the Ombudsman regarding a person’s privacy is clear:
Section 9(2)(a) of the Official Information Act 1982 applies when
withholding is necessary to protect the privacy of natural persons,
including deceased natural persons.
For withholding to be ‘necessary’, there must be a reason to believe
release would affect the privacy of the individual(s).
There is no requirement for the effect to be significant, unreasonable or
unwarranted, but it should be more than negligible.
The release of official information may affect the privacy of the
individual(s) where it would:
· reveal their personal information; or
· in some way intrude on their privacy—for example, by affecting
their dignity or their mental or emotional wellbeing, by damaging their
reputation, or by exposing them to unwanted contact or attention.
You may make a complaint regarding our use of s9(2)(a) with the Ombudsman.
Kind regards
Kāinga Ora.
