I refer to your request of 5 March 2022 asking for information held by the
Whangarei District Court on any court attendance, court case, charges or
conviction of Mr Clarke Timothy Gayford within the months of February and
March 2022.

 

I note that the District Court falls within the jurisdiction of the
Ministry of Justice rather than Council as a central government rather
than local government function.  I am wondering therefore whether you have
may referred your request to Council in error?

 

I am happy to transfer your request formally to the Ministry of Justice if
you would like me to.  However, I note that official information
legislation does not generally apply to information held by the courts. 
This includes sentencing notes, court records, transcriptions or
information about a case currently before the courts.  However, the
Ministry of Justice website indicates that access to this sort of
information is dealt with by separate legislation and court rules and so
you will need to contact the relevant court directly.

On 9 March 2022 my colleague responded to your request letting you know
that the District Court falls within the jurisdiction of the Ministry of
Justice rather than Council, and offered to transfer your request to the
Ministry of Justice.  We have not heard back from you on this.  As a
result, this request will be closed on 1 April 2022.  Please let me know
if you have any further concerns outstanding.
