I refer to your request of 20 January 2023 for information regarding
“goods vehicles”. Your request was referred to the Health and Bylaws
Department, and Regulatory Services Contractor Armourguard for
consideration.
Your request:
I am requesting all information held around the definition of a "goods
vehicle" in context of transport/parking, bylaws/decisions/discussions
either made by WDC staff or by council around or involving "goods vehicle"
within transport/parking contexts and all training material and related
documents used by parking wardens either employed by WDC directly or
provided by contractors
Response:
Both Council and its Parking Enforcement Contractor (Armourguard) are
guided by the definition set out in the Land Transport (Road User Rule
2004) pasted below in decisions relating to ‘goods vehicles’.
When a vehicle used in the course of trade but is unmarked it is very
difficult for parking officers to determine if it is a member of the
public making a personal drop off, or someone ‘in trade’ making a trade
related delivery or pick-up.
If a driver utilising an area restricted to ‘goods vehicles’ appears to
the parking officer to be a member of the public then they will not
unreasonably issued an infringement. However if that driver then provides
evidence or information to satisfy the definition then the infringements
are waived.
I hope this information is of some assistance in responding to your
request. If you believe we have not responded appropriately to your
request, you have the right by way of complaint, under section 27(3) of
the Act, to apply to the Ombudsman to seek an investigation and review of
the decision.
