National/foreign or international court/justice/committee. National/foreign or international administration/agency/police force/task force. Any national/foreign or international official/state service/ambassador/dignatary/country or embassy recognised or unrecognosed regarding yourself at any point of time but especially during your tenure as Prime Minister and any replies/further communications that resulted.

I am emailing from the Prime Minister’s Office regarding your recent
Official Information Act 1982 (OIA) request for information regarding
information on criminal proceedings received by this Office.

 

It is often the case that requests prefaced with “any information” or “all
information” can lead to a refusal due to substantial collation. In this
instance, I believe responding to your request would require manually
searching and cross-referencing a large volume of information, involving a
search across multiple databases, to determine whether each and every
piece of information held is within the scope of your request. Your
request as it currently stands would likely be refused under section 18(f)
of the Official Information Act 1982 as the information requested cannot
be made available without substantial collation or research.

 

We therefore kindly ask if you would consider refining the scope of your
request. This could be done by either specifying a particular document you
are interested in, specifying which criminal proceeding this office might
likely hold information on, or any individual (other than yourself) that
we can narrow our search to. Doing so will help us to more readily provide
a response to your request.

 

We would appreciate it if you could please respond to this email by 9
September 2021. If we do not receive a response from you by this date,
your request will be refused under section 18(f) of the Official
Information Act 1982.

Thank you for your email asking how much is the collation expense for your
request is as currently worded.  As advised in my earlier email your
request as currently framed would require extensive searching for
documents within scope over a significant period of time.  The Prime
Minster is not the primary holder of the sort of information you have
requested. Although the Prime Minister may have received advice, one of
the most likely sources of any relevant information would be Ministerial
correspondence on criminal investigations and proceedings received from
members of the public. Any such correspondence would need to be assessed
for potential release, including taking into account privacy
considerations.

 

While agencies are authorised to impose reasonable charges for the costs
of making information available (for example the cost of printing /
scanning documents, or of discs or other electronic storage devices for
delivery of information) this is only in the situation where a decision
has been made to release the information requested.  The guidance for
agencies is that they are unable to charge for the time spent deciding
whether or not to release information.  Therefore the issue with your
request is not the cost that would be incurred by the organisation in
collating the material but how difficult if it is even possible it would
be to locate all the information you have requested. The time and resource
that's would be required to attempt to locate any information relevant
respond to your request would be excessive. Therefore we are not in a
position to quantify  your request.

 

Given that our preference is to respond to your request free of charge, we
kindly ask if you would consider refining or clarifying the scope of your 
request as per our previous email to you by either specifying a particular
document you  are interested in, specifying which criminal proceeding this
office might  likely hold information on, or any individual (other than
yourself).

 

Alternatively, I suggest that you also get in touch with the Ministry of
Justice, the New Zealand Police, and the Department of  Corrections as the
responsible government agencies on this topic.

 

I would appreciate your response to this email by Friday 24 September 
2021.  If we have not heard from you by this date, we will consider your
request as it is currently framed. You can contact us to discuss our
