Section 2 of the Official Information Act 1982 states that ‘official
information’:

(a) means any information held by—

(ii) a Minister of the Crown in his official capacity.

 

Information that is held in any other capacity, such as Leader of the New
Zealand Labour Party, as a Member of Parliament or as a private
individual, is not official information and falls outside the scope of the
Act. The Prime Minister  attended this event  in her capacity as Labour
leader, rather than Prime Minister or member of the Cabinet.  Therefore
your request is not considered a request for official information under
the Act.
