Resource consent application response timeframe

Dear Auckland Council,

Under the Unitary Plan Chapter C 1.2.2 it states " The council may, within 10 working days after an application is first lodged, determine that the application is incomplete if it does not include the required information and return it to the applicant" so does this mean that if I don't get a response from Auckland Council on my resource consent application after 10 working days then I can assume the application is accepted and no more information is required?

If not then does that mean Auckland Council is not meeting the Unitary Plan requirements?

I refer to your email query dated 13 November 2020 regarding the resource
consent application response timeframe process. 

 

All resource consent applications are different and need to be considered
accordingly.  Not knowing the specific background which your query relates
to, I can only provide you with basic information.

 

The Unitary Plan Chapter C 1.2.2  provisions aligns with Section 88 of the
Resource Management Act (RMA), with the requirement for council to check
the resource consent  application once submitted for completeness and the
adequacy of information within ten working days, after which a
determination is made whether to accept or reject the application.  The
primary purpose of this process is to ensure that the applicant has
provided complete, accurate, and appropriate information.

 

Once the council is satisfied that the application can be accepted, you
will receive a letter stating this.  If you have not received a letter
after the ten-day period, it is recommended that you to contact the
processing planner as soon as possible.

 

Please also note that the council has the ability under section 37 of the
RMA to seek and extension or double the resource consents processing
timeframes.

 

It is also important to note that the section s88 lodgement check is an
initial high-level review for information, and that further information
may still be required under s92 of the RMA following a detailed review of
the application, which usually includes a site visit.

 

I trust the above provides clarification in respect of the section 88
acceptance/rejection of an application process.
