Management of Waste as an important Long Term Plan issue

Dear Auckland Council,

The 2021-2031 10 Year Budget (Long Term Plan) consultation document and supporting documents are consultation documents following the special procedure requirements of the Local Government Act 2002 (LGA).

These long term plan documents make no reference to a new regional landfill. Nor does any new regional landfill provision appear in the Auckland Plan 2050.

The private proposal to establish a regional landfill at Wayby valley has received significant attention and the plan change and resource consent application to vary the Unitary Plan are currently under consideration by Commissioners.

Management of regional waste is a significant and important issue and Auckland Council (AC)’s plans for that are set out in Auckland’s Waste Management and Minimisation Plan of 2018 which aims for zero waste by 2040 and has no reference to a new regional landfill.

Please provide any documents associated with the preparation of the Long Term Plan consultation documents that:
* refer to the proposal for a new regional landfill in the Wayby Valley (or elsewhere);
* identify whether the provision of a new regional landfill is a significant or important issue or choice;
* refer to whether or not provision of, or for, a new regional landfill should be provided for in the proposed long term plan;
* consider how the local authority is informing discussions with its communities about this choice; or
* refer to whether AC is complying with the requirements of the LGA by not including reference to the new landfill in the consultation document, or by failing to refer to whether or not AC has any plans for a new regional landfill or alternatives for waste disposal.

Further to your response I have the following questions as an additional or new LGOIMA request.

1. When did Auckland Council, [including any of its subsidiaries and controlled companies] (AC) first become aware of the intention, or proposals, or Waste Management NZ (WMNZ) to establish a new regional landfill at Wayby Valley (the Proposal)?

2. Please provide details and associated correspondence of any discussions AC has had with landfill managers for the disposal of residual waste to landfill beyond when the Redale landfill’s consent expires in 2028.

3. Please provide all correspondence (including emails or other documents) between AC and WMNZ from the period when AC first became aware of the WMNZ Proposal or Jan 2014 (whichever is the earlier) until WMNZ had its resource consent application accepted by AC (13 March 2020).

4. Please identify any of that correspondence between AC and WMNZ that relates to capacity at the WMNZ landfill at Redvale?

5. Please advise how much AC has spent annually for disposal of residual waste-to-landfill annually since 2014 at Redvale and at other landfills separately.

6. Please provide non-commercial details of any contracts between AC and WMNZ for disposal of waste at Redvale or elsewhere, including initiation, renewal and expiry dates and similar details for any other contracts AC has with alternative landfill managers for waste disposal.

7. Does AC have any preliminary understanding or agreement (formal or informal) with WMNZ for the disposal of waste to the new regional landfill if the Proposal is finally approved?

8. Please advise AC’s policy for awarding contracts for residual waste disposal to landfill, including criteria for selection; and whether the contract includes transport to landfill or if that is a separate contract or contracts.

9. Please advise AC’s current plans and intentions regarding the disposal of residual waste to landfill once the consent at Redvale expires in 2028, including which alternative landfill sites have been considered, if the Proposal is not approved.

Dear Jenny Hua,
I thought I had replied to this query sorry.

My original request is for the annual costs (what AC pays to the operator, either directly or through contractors used to transport waste to landfill) since 2014 for disposal of any and all types of waste at each of the landfills it uses (used). I was requesting the costs of actually using/accessing the landfill for disposal, not including the collection or other processing or transport costs of getting waste to the landfill, although e.g. (hypothetical since I don't know) if AC has contracts for transport and disposal which do not separate out the landfill use cost component I would not expect those to be separated out but just explained.

If the information is disaggregated or held separately by the type of waste service which disposes of waste at a landfill i.e. to Council Refuse, Inorganic, Illegal Dumping and Refuse Transfer Station waste, that would be helpful thank you.

To restrict the correspondence search, may I request the following:

For Question 2 please restrict the request timeframe to Correspondence since Jan 2014. The results should indicate whether correspondence from any earlier timeframe is useful and, if so, can be the subject of a further later request. N.B. please read the misspelled "Redale" in my question as "Redvale".

For Question 4, a search on the outcome from Question 3 will be helpful thankyou (see below). i.e the same timeframe (since Jan 2014).

For Question 3 Key search terms for email search are: - ANY OF:
SENDER contains wastemanagement
TO contains wastemanagement

For Question 4 - from the Q 3 search results: search for:

Dear Jenny,

Thank you for your seasonal good wishes which are appreciated and reciprocated.

Given the extended time taken to process my request and the reason given for that extension being to review the emails before releasing them, and the fact that this has not been done and a blanket refusal to provide given - rather than just providing me all the emails in response to question 3 - I will be asking the Ombudsman to review this decision.

I also consider your reason for refusing to provide the responses to my queries 2 and 4 inadequate since the "experts" reviewing the emails have no reasoned basis for advising that the emails which met my modified request "are not relevant and considered out of the scope of your questions". Since my modified request was for particular emails and the search provided those I would have expected them to be provided unless there were reasonable (e.g.privacy) reasons for rejection. If not I ask that you provide those 244 emails so that I do not include them in my request to the Ombudsman for review.
