New residential address of car mechanic

Simon Carey-Smith made this Official Information request to Kāinga Ora–Homes and Communities

The request was refused by Kāinga Ora–Homes and Communities.

From: Simon Carey-Smith

Dear Housing New Zealand Corporation,

My wife and I had our car with a mechanic who works from home. He took our deposit and didn't diagnose or fix the car hence we are in the process of taking him to the Disputes Tribunal. We require his residential address for the Tribunal claim application.

His name is Michael Herzog. His former residence is 7 Oliver St, Wakari, Dunedin. His house is provided by Housing NZ. He moved to a new location in Dunedin on the 5 May 2018, also provided by Housing NZ.

Would you please disclose to us as soon as possible, under the Official Information Act, his new address.

Yours faithfully,

Simon Carey-Smith

Dear Mr Carey-Smith

I am sorry to hear about your situation. Unfortunately, I am unable to provide you with the information you have requested. To protect our tenants' privacy, Housing New Zealand does not disclose their addresses. Information about our tenants, including their addresses, is held in confidence.

I do not believe the public interest outweighs the grounds for withholding it.

The following sections of the Official Information Act 1982 apply:

- Section 9(2)(a) protect the privacy of natural persons
- Section 9(2)(ba) protect information which is subject to an obligation of confidence

You have the right to seek an investigation and review by the Ombudsman of this decision. Information about how to make a complaint is available at www.ombudsman.parliament.nz or freephone 0800 802 602.

Yours sincerely
