Dear Far North District Council,

There was a meeting in early February at FNDC between myself, my Maori Agent and Ted Wihongi of the FNDC, at which a written request was made by us, for all information regarding FNDC involvement in the actions taken by Police at Te Tii during the days around the annual Waitangi commemorations at Te Tii. In particular, the actions of Police in regard to the license to occupy our own whenua, Te Karaka Tapu and nearby land, which was issued by FNDC.

We spoke with Ted Wihongi and made our request perfectly clear, Mr Wihongi undertook to provide this information months ago and has failed to provide any of it.

This request is now overdue and we request that priority is accorded to this updated reminder, and that the information requested is provided without further delay.

This includes all correspondence with any individuals or organisations regarding the application for the license to occupy the whenua known as Te Karaka Tapu Historic Reserve and the whenua referred to in the license to occupy (issued by FNDC and contained in the information we are requesting) as "The Island" and "Shippeys Reserve".

In particular we request all communications between FNDC and Police regarding the enforcement of the license to occupy and any other related matters.

In particular we also arequest all information regarding the source of the absurd claim made by FNDC that they, FNDC, have ownership and legitimate title to our whenua, our wahi tapu, to tatou Karaka Tapu, he taonga o tatou matua tipuna, as claimed in the purported license to occupy which was granted from 1 - 7 February 2018.

We wish it to be noted by FNDC that there was strenuous opposition to the proposed occupation of this land and the authority of both Police and FNDC was totally rejected and Police complied with our orders to leave and to disregard your claimed authority. Note that the actions of the FNDC are viewed extremely seriously by myself and my peers and Ngapuhi in general - the FNDC is acting ultra vires in granting anyone a license to occupy Ngapuhi whenua.

I refer to your information request received 15 April 2018 which has been
referred to Legal Services for consideration in accordance with the
provisions of the Local Government Official Information and Meetings Act
1987 (“the LGOIMA”).

 

Information request

You have requested the following, and I quote:

 

“ … correspondence with any individuals or organisations regarding the
application for the license to occupy the whenua known as Te Karaka Tapu
Historic Reserve and the whenua referred to in the license to occupy
(issued by FNDC and contained in the information we are requesting) as
"The Island" and "Shippeys Reserve".

Council response

 

A licence to occupy was not issued as you refer, however a permit to
occupy the land for a short term was granted. Please refer to the attached
zip file for a copy of the permit. Also provided within the zip file is
correspondence held by Council regarding the permit application including
communications between FNDC and the Police as held by Council. Pursuant to
section 7(2)(a) of the LGOIMA any reference to personal information
(outside of Council Officers) have been redacted. Also provided within the
zip file is documentation pointing to the classification of the land you
refer and the local authority with which the land vests.
