2. if so who is this person or company
3. what obligations are there under any agreement for the provision of services as per the advertised time table on the ak transport web site
4. if there is a contract in place is there a subsidy provided to this person/organisation for the supply of this public service. if so how much is provided for this service
5. how is compliance with this contract monitored and by whom
6 what are the consequences for breaching the terms and conditions of the contract/ agreement
7. who were the signatories to any agreement for the supply of public transport to the airport, ie who signed on behalf of Ak transport and who signed on behalf of the service provider please provide a copy of the contract.
8. when was it signed.
9 what redress is there for those persons who rely on the service and are left stranded.
10 How do you make a complaint about the lack of service
11,who is liable for losses suffered by those who miss their flight due to no bus arriving.
Urgency is requested as it has come to my notice that members of the public are regularly left stranded and miss their flights. We wish to prevent more inconvenience on persons who have a right to rely on the integrity of the public service

Thank you for the information on Sky bus. the responses require clarification and expansion
by way of Lgoima I request the following and make the following comments
1. There can be no MOU with sky bus as Sky bus is an undefined trading name . the Mou does not contain the word sky bus . please correct the LGOIMA response
2.Please provide the evidence which you rely on that " sky bus" is an exempt service under the land transport management act
3.the Mou which has been provided is not dated and not signed , neither is it with " sky bus" please provide a copy of a valid MOU
4.How does AT communicate and co ordinate with sky bus is it does not exist or defined , please advise who you are communicating with and coordinating with and when was the last time this was done.
5. please provide a copy of the monitoring reports done for the period 1 June to 14 June 2016
6 You say the consequences of breaching he agreement is termination , I wish to point out that the web site skybus.co.nz is shown as being owned by SkyBus Coach Services, Lauren, Hammond. there appears to be nothing at all connecting the MOU with the people who appear to run Sky bus. What evidence does AT have that shows that the company whihc allegedly holds the MOU operates the services or subcontracts.
7.please provide a copy of the MOU so that the director of airbus Auckland can be identified and it can be ascertained if that person was indeed a director and capable of signing the document on his own.
8.you state " Airbus Auckland Limited (owned by SkyBus)" please provide evidence of this
9. Getting to the airport is crucial , terms of carriage cannot apply when no one was carried . please provide the evidence which you rely on for your response that "Liability (if any) would be between SkyBus and the passenger and limited by the SkyBus terms of carriage"
10 The MOU does not contain the words Skybus, How is the public to know that skybus is the trading name for aal holdings limited , please provide evidence that AT has verified that skybus.co.nz is the web site of the person holding the MOU .
11 In this instance travel was well outside peak times there was no issue with traffic the bus simply did not show If AT cant even get the name right of the person providing the service then please advise how AT can possibly monitor the service.

You provide me with a diagram whihc shows the company structure for sky bus showing AIRBUS EXPRESS LIMITED owned by AIRBUS HOLDINGS LIMITED owned by AATS NZ HOLDINGS LIMITED owned by the Australian company AATS Holding Company Pty Ltd.You allege that this is hte company which provides the sky bus service and you claim to regularly communicate with Skybus Directors (Adam Begg and Michael Sewards) Adam Begg and Michael Sewards are shown on the companies register to be directors of AATS NZ HOLDINGS LIMITED (5742389) and AIRBUS EXPRESS LIMITED (5270621) and AIRBUS HOLDINGS LIMITED (5298061)
You produce a MOU signed on 7/3/14 between Auckland transport and Auckland airbus limited Craig Brownie signed for Auckland airbus the signature was witnessed by Nigel Spratt
Spratt and Brownie are both directors of Auckland airbus limited which changed its name to AAL HOLDINGS LIMITED 8 august 2014 . AAL HOLDINGS LIMITED is owned by BANCORP CAPITAL LIMITED which in turn is owned by BANCORP WEALTH MANAGEMENT NEW ZEALAND LIMITED
Auckland transport is therefore contracting to one company and dealing with the directors of an other company with whom there is no legal connection this would appear to require urgent explanation and investigation . I look forward to receiving clarification

2016 expressing some concerns about AT’s responses in relation to the
Memorandum of Understanding and seek further explanation and an
investigation into the matter.
Applicability of the LGOIMA to your correspondence
I refer to the following extract from “The LGOIMA for local government
agencies, A guide to processing requests and conducting meetings” (page 6)
available on the Ombudsman’s website:
For the LGOIMA to apply, the information must be held by the agency
concerned. With the exception of providing a response to a request for a
statement of reasons, there is no obligation on an agency to form an
opinion or create information to answer a request.
If a requester seeks information by asking a question, there is a
distinction between:
• questions which can be answered by providing information
already known to and held by the agency (official information); and
• questions which require the agency to form an opinion or
provide an explanation and so create new information to answer the request
(not official information).
Your recent correspondence of 31 August 2016 posed some questions which
required AT to create new information by forming an opinion or providing
an explanation (the second bullet point). These matters are not official
information and fall outside the scope of LGOIMA.

Thank you for your furthur questions regarding the company structure of
the Skybus.
Auckland Transport can advise that Mr Brownie did sign the MoU in his role
as director of AAL Holdings/Bancorp. AAL Holdings/Bancorp subsequently
sold the Airbus business to Johnstones Coachlines. Johnstones Coachlines
then sold the business to the Skybus Holding Company.
AT has followed the due process with appropriate novation and
sale/purchase approvals as required under the MoU for each transaction.
Therefore, the MoU is now with the Skybus Holding Company.
I hope the above information clarifies our position on the matter.

We refer to your request for information relating to the Skybus Memorandum
of Understanding, in particular any due diligence the provision of an
airport bus service is subject to, copies of documents which shows there
is a legally enforceable agreement between AT and the said Skybus
Holding Company including their legal name and the date on which they took
over the service, as well as AT’s consent to the transfer of the service.
As a significant amount of work is required to provide the information you
are seeking, Auckland Transport will impose a charge, under Section 13 of
the LGOIMA to cover the cost of the labour and materials involved in
making the information available.
Auckland Transport’s charging policy details the amount that can be
charged for the supply of information as follows:
· The first five (5) hours of time spent on fulfilling official
information requests will be free; and thereafter a charge of $47.50 for
each additional half hour;
· Twenty (20) pages of free photocopying, thereafter a charge of
20c per page for photocopying;
· All other charges incurred shall be fixed at an amount that
recovers the actual costs involved.
We have estimated that 9 hours of time is required to collate the
requested information; the cost estimate based on 4 hours is therefore
$380.00.
You have a right to seek a review by the Ombudsman of the estimated
charge. If you wish to exercise this right please advise us as soon as
possible so we can place your request on hold pending the outcome of the
review.
Accordingly should you wish to proceed with this request, please arrange
to either forward to us your cheque for, or electronically transfer
$380.00 to our account, details of which appear below:
