Dear Waka Kotahi NZ Transport Agency,

To whom it may concern,

I make the following request under the Official Information Act 1982. This request is made via the FYI.org.nz website and I am happy for both the request and the response to be published there.

This request concerns Vehicle Safety Officer / Authorised Officer Arno Roosendaal, officer number ARDA85, of the New Zealand Police Commercial Vehicle Safety Team, who issued infringement notice PV6876813 and has been referred to in internal Police correspondence released to me under OIA IR‑01‑25‑16857.

1. Appointment / approval as enforcement or authorised officer

Please provide:

a. Any record held by Waka Kotahi of the appointment, approval, or authorisation of Mr Roosendaal as an “enforcement officer”, “authorised officer”, or equivalent for the purposes of enforcing land transport legislation (including work‑time and logbook requirements).

b. The date(s) on which any such appointment/approval took effect.

2. Delegations and infringement powers of Vehicle Safety Officers

Please provide:

a. Any current or historical delegation, policy, schedule, guideline or circular held by Waka Kotahi that sets out which categories of infringement offences may be issued by Vehicle Safety Officers (VSOs) within the Commercial Vehicle Safety Team (or equivalent roles), as opposed to those that may only be issued by sworn Police constables or other classes of officer.

b. In particular, any document confirming which agencies and officer types (for example, Police VSOs, Police constables, NZTA enforcement staff) are authorised to issue work‑time and logbook infringement notices under the Land Transport Rule: Work Time and Logbooks 2007 and associated regulations.

c. Any Waka Kotahi document that describes, in general terms, the powers of Vehicle Safety Officers or similar officers, including but not limited to the ability to:

inspect commercial vehicles for compliance, and

issue infringement notices (for example, speeding infringements, logbook/work‑time infringements, or other categories).

3. Any limits or exclusions

Please provide any document held by Waka Kotahi that records:

a. Any limits, exclusions or conditions on the infringement powers of Vehicle Safety Officers as a class; or

b. Any statement that distinguishes the powers of VSOs from those of sworn Police constables or NZTA/Waka Kotahi enforcement staff in relation to infringement notices.

If any part of this request is more closely connected with the functions of NZ Police, please transfer that part of the request to Police under section 14 of the Act or advise me so that I can redirect it.

If any part of this request is likely to be refused or would require substantial collation, please contact me via FYI so that I can refine or narrow the scope.
