Dear New Zealand Police,

To whom it may concern,

I make the following request under the Official Information Act 1982. This request is made via the FYI.org.nz website and I am happy for both the request and the response to be published there.

This request concerns Vehicle Safety Officer / Authorised Officer Arno Roosendaal, who issued infringement notice PV6876813 and has been referred to in internal Police correspondence released to me under OIA IR‑01‑25‑16857.

Appointment as enforcement / authorised officer

Please provide:

a. A copy of the written instrument(s) by which Mr Roosendaal has been appointed as an “enforcement officer”, “authorised officer”, or equivalent under the Land Transport Act 1998 and related land transport rules.

b. The date(s) on which any such appointment(s) took effect.

Delegations and infringement powers of Vehicle Safety Officers

Please provide:

a. Any current or historical delegation, policy, schedule or other document that sets out which categories of infringement offences may be issued by a Vehicle Safety Officer (VSO) within the Commercial Vehicle Safety Team, as opposed to those that may only be issued by sworn constables or other classes of officer.

b. In particular, any document confirming whether VSOs are authorised to issue work‑time and logbook infringement notices under the Land Transport Rule: Work Time and Logbooks 2007 and associated regulations.

c. Any Police or NZTA/Waka Kotahi document that describes the powers of VSOs, including but not limited to the ability to:
- inspect commercial vehicles for compliance, and
- issue infringement notices (for example, speeding infringements, logbook/work‑time infringements, or other categories).

Any limits or exclusions

Please provide any document that records:

a. Any limits, exclusions or conditions on the infringement powers of Mr Roosendaal personally (for example, offences he is not permitted to issue notices for); or

b. Any general limits or exclusions that apply to VSOs as a class, distinguishing them from sworn Police constables.

If any of the requested information is held by Waka Kotahi NZ Transport Agency rather than Police, please either transfer that part of the request under section 14 of the Act, or advise me so that I can redirect it.

If any part of this request is likely to be refused or would require substantial collation, please contact me so that I can refine or narrow the scope.
