As related to the history of Rotunda development where the developers have walked away from the. project.

Quoting the above news, the stall was before reasoned by Maurice Clark as:

> Cheops Holdings managing director Maurice Clark said that was because they had not found a restaurateur willing to take it on.

Please share:

A) The original proposal by Cheops Holdings / Maurice Clark

B) The contract between WCC and Cheops Holdings, McKhee Construction

C) Notices / updates to the council by the developer when things didn't go to plan

It is important for the public to understand what went wrong and how this site sits empty without any productive use for the benefit of the ratepayer.

Thank you for your below email of 7 May 2026 to Te Kaunihera o Pôneke | Wellington City Council (the Council), requesting information about the Band Rotunda Development and Cheops Holdings/Maurice Clark/McKhee Construction.

Your request is being considered under the Local Government Official Information and Meetings Act 1987 (LGOIMA).

This email is to advise you that the Council needs to extend the due date of your response for 10 working days, pursuant to section 14(1)(b) of the LGOIMA, as consultations necessary to make a decision on the request are such that a proper response to the request cannot reasonably be made within the original time limit.

For this reason, you can expect a response from the Council no later than 19 June 2026.

I do not believe that you have ground/s under s. LGOIMA 7(2)(h) to withold the information I have requested.

Wellington City Council does not have commercial function on this matter.

If you are intending to rely on s. 9(2)(b)(ii) where third party must be either the supplier or the subject of the information.

A mere assertion of prejudice will not be sufficient; nor will vague and unsubstantiated references to ‘commercial sensitivity’ or ‘confidentiality’. Agencies must be able to:

1. demonstrate that the third party has a commercial position; and

2. explain how release of the information at issue would be likely unreasonably to prejudice that position.

I note that you did not explain your reasoning nor demonstrate what exact commercial position there was.

It is important to consider all the information contained in a document, and not just the document as a whole. Commercial documents, such contracts, can often be released in part without any prejudice.

Agencies must identify the nature of the predicted prejudice: how precisely would release of the information at issue prejudice or impair the third party’s commercial position?

I note that this happened years ago and the situation is and was unique and would bear no correlation to the proposals or contracts that might be expected after redevelopment especially given it never happened and was a failure that costed the rate payers unknown amount of money and goodwill by having public land & property sitting empty.

It would significant leap to suggest that this knowledge would be likely to unreasonably prejudice the commercial position of previous developer or council where there is no real commercial activity.

You also failed to consider public interests:

- Accountability for how regulatory agencies perform their functions, including undertaking investigations and awarding licences & grants.

- Accountability for awarding contracts, grants or subsidies

I will quote Wyatt Co (NZ) Ltd v Queenstown- Lakes District Council:
"It is fundamental that the public are to be given worthwhile information about how the public’s money and affairs are being used and conducted, subject only to the statutory restraints and exceptions"

Please reconsider and release the information that was requested.
