Thank you for your email of 7 May 2026 to Te Kaunihera o Pōneke | Wel ington City Council (the
Council) requesting information regarding the previous contract between Cheops Holdings and the
Council for the Band Rotunda
. Your request has been considered under the Local Government Of icial
Information and Meetings Act 1987 (LGOIMA). Please find my response below.

As related to the history of Rotunda development where the developers have walked away
from the project.

Quoting the above news, the stall was before reasoned by Maurice Clark as “Cheops
Holdings managing director Maurice Clark said that was because they had not found a
restaurateur wil ing to take it on.”

2. The contract between WCC and Cheops Holdings, McKhee Construction
I am withholding information relevant to the above two questions pursuant to section 7(2)(h) of the
LGOIMA, to enable any local authority to carry out, without prejudice or disadvantage, commercial
activities.
As per section 7(1) of the LGOIMA, I do not consider that in the circumstances of this response, the
withholding of this information is outweighed by the other considerations which render it desirable to
in the public interest to make the information available.

Notices / updates to the council by the developer when things didn’t go to plan
It is important for the public to understand what went wrong and how this site sits
empty without any productive use for the benefit of the ratepayer.
I am refusing this portion of your request pursuant to section 17(e), as the document al eged to
contain the information requested does not exist or, despite reasonable efforts to locate it, cannot be
found.
