This pertains to the notice of decision - resource consent for SUBDIVISION (SUB 5985) (Oasis #: 16306886).
Under the section conditions:

8. Prior to requesting approval under Section 224 of the Act, the consent holder must
provide written confirmation that the existing accessory buildings over the proposed
boundary of Lots 2 and 3 have been removed or relocated to a position that complies
with the District Plan.
9. Prior to requesting approval under Section 224 of the Act, the consent holder must
provide written confirmation that the water pump shed within the proposed road to
vest (Lot 11) have been removed or relocated to a position that complies with the
District Plan.
Note: A Building Consent application will be required to carry out this work.

Dear LGOIMA Requests,
Thank you for your response. I have posted it on fyi.org.nz as an annotation.
In regards to request 3 ( I am requesting a copy of the building consent application that would have been filed by the consent holder (expected to be Matt Currie) under items 8 and 9 above.) Your response was "A building consent was not required for the accessory buildings; therefore, no application was submitted. Pursuant to section 17(e) of the LGOIMA, your request is refused as the information sought does not exist."
I am now asking for a clarification regards the meaning of the Note at the end of section "REMOVAL OF EXISTING BUILDINGS" in the Conditions of Consent section of the Decision Report as it relates to the response from council above. That note is: "Note: A Building Consent application will be required to carry out this work."
I further request a Building Consent application in regards to item 9 the the water pump shed. This was not addressed in the initial response from council.

I received a response via email on 6/3/2026. The response is between ******* lines below. The response states no building consent was required for the accessory buildings. However, it was required in the by the following in the Decision Report which by my reading applies to items 8 and 9: "Note: A Building Consent application will be required to carry out this work." The whole of the section from the Decision Report was included in my request. It is unclear to me how something that was required in the Decision Report was somehow thought to be not required by the PNCC Manger of Planning Services.
If one reads the Decision Report 'note' as only applying to the item directly above it (9) then a Building Consent application should exist for the pump house related activities. The answer did not address that.

Our Manager Planning Services has advised the following:
Q1. I am requesting a copy of the written confirmation that existing accessory buildings under section 8 have been removed or relocated.
Condition 8 and 9 of SUB 5985 requires written confirmation of the completion of the removal of building and the water pump shed within the proposed road to vest. A copy of the Section 223/224 letter provided by the applicant’s technical representative is attached.
Reason for withholding information
We have withheld information in the letter under section 7(2)(a) of the LGOIMA. This section provides that there is good reason for withholding information where it is necessary to protect privacy of natural persons. In this instance the name and signature of the individual have been redacted. This information is not publicly available. We have considered the public interest when withholding this information but consider the privacy of an individual outweighs the public interest in this instance.
Q2. I am requesting a copy of the written confirmation that the water pump shed within the proposed road to to vest has been removed or relocated.
At Section 223/224 (of the RMA) stage for consenting process, the applicant (Resonant) provided the written notice that the building over lots 2 and 3 and the water shed have been removed. Council accepts the written notice as meeting these conditions. A copy of the letter provided by the applicant’s technical representative summarising the completion of conditions on SUB 5985 and SUB 5501 is attached.
Reason for withholding information – please refer to the note above in Q1.
