scope – for example, by refining your request to formal written documents
and/or a manageable timeframe, and/or removing internal Ministry
communications from the request.

 

We look forward to hearing from you. Once we have your refinement, we will
commence work on your request.

or clarification of a request is sought within seven working days of the

It is worth noting, we have previously advised that this request is very
broad in nature and scope, to which you clarified you are happy to refine
the scope of the request to be for ‘emails or formal documents’. Feedback
may be exchanged across multiple individuals through email, and therefore,
to make the requested information available may still amount to
substantial collation. We have interpreted your new request as including
the refinement from your earlier request, as reflected above, and the

are needed due to the potential workload and/or consultations involved in

The Ministry may publicly release on our website the response to your
request five days after you have received it. Any personal information

Thank you for your response. I would like to request that you reconsider the application of section 9(2)(g)(i), as I do not believe the criteria for withholding have been met in this instance.

To be clear, I have no objection to the withholding of names or any other personally identifying information under section 9(2)(a).

However, I disagree that section 9(2)(g)(i) provides a justified ground for withholding the remaining information. My reasons are based directly on the Ombudsman’s guidance on free and frank opinions (section 9(2)(g)(i)):
1. Release would not inhibit the future exchange of free and frank opinions.
The information appears to be written feedback from external experts. When names and identifying details are removed, the Ombudsman notes that disclosure of unattributed or anonymous opinions is less likely to inhibit future free and frank expression.
2. The effective conduct of public affairs would not be prejudiced.
The feedback does not appear to fall into any of the categories that typically require protection—such as early policy development drafts, informal off‑the‑cuff advice, or crisis‑response coordination. These are the types of material the Ombudsman has identified as potentially warranting withholding. This request does not involve that kind of information.
3. Consultants and professional experts are unlikely to be inhibited.
The Ombudsman’s guidance is clear that consultants or specialists commissioned for their expertise are generally expected to provide robust, professional advice and are unlikely to be deterred by disclosure of non‑identifying material.
4. Public interest in release is particularly strong and time‑sensitive.
The draft curriculum is currently open for public feedback. Many teachers and members of the public would benefit from understanding the perspectives of experts when preparing their own submissions. The value of releasing this information is therefore directly tied to a live public decision‑making process.
Given this timing, the public interest in accountability, transparency, and informed participation outweighs any hypothetical risk of inhibition.

For these reasons, I request that the documents be released in full, with only personal identifiers redacted.
