Dear Broadcasting Standards Authority,

S30(A) of The Broadcasting Act requires all broadcasters to give the BSA an annual return of revenue by 31 July.

Can you please provide for each of the last three years, a list of which broadcasters the BSA has sent the annual return form to, asking for it to be returned.

The following information may assist you with your inquiry:

* Complaints must first be sent to the broadcaster, unless the complaint
is ONLY about the privacy standard (in which case the complaint can be
sent directly to us). If you wish to make a formal complaint to the
BSA about a broadcast programme, please ensure you have first
complained to the broadcaster.
* If you have complained to the broadcaster and you do not hear from
them within 20 working days, you can refer your complaint to us.
* If 20 working days have not yet passed since your original complaint,
the broadcaster still has time to consider your complaint.
* If you have received the broadcaster’s response and you are referring
your complaint to us for review, a member of our team will be in touch
shortly to outline next steps.

Please contact the [1]New Zealand Media Council if your complaint is about
content of newspapers, magazines and periodicals in circulation in New
Zealand including their websites 
Please contact the [2]Advertising Standards Authority if your complaint is
about an advertisement (other than promotional material for a scheduled
programme).

Dear David

 

We just wanted to check if the purpose of your two Official Information
requests received today is to confirm whether the BSA has sought to
enforce Broadcasting Act requirements around annual levy returns and
publicity notices with respect to online broadcasters.

 

If so, we can confirm that our accepting the current complaint is in line
with a BSA policy published in 2020. This said that we would not be
extending levy or publicity notice requirements to providers of online
content at that time. But if we received a relevant complaint and there’s
no other applicable standards body or regulator, and if the complaint
raises issues of public interest or a risk of harm, we may accept the
complaint and engage with the parties using our established processes.

 

Having now received the first complaint referral about an online
broadcaster that meets the requirements of the Act, that’s what we’ve
done. However, consistent with our published approach, we have at no stage
sought to extend levy or publicity notice requirements to providers of
online content.

 

If the above gives you the information you need and you would like to
withdraw the relevant OIA requests relating to other broadcasters, please
let us know. Otherwise, our legal team will process these requests in the
normal way and respond to you as soon as possible.
