Your request is being considered under the Local Government Official
Information and Meetings Act 1987 (LGOIMA).  
 
This email is to seek clarification on your request. As currently worded,
your request would require the collation and assessment of a considerable
number of documents from the Council’s systems. Officers would need to
review each individual parcel city wide to determine if they contain
rights of way. This would take months for our officers to collate and take
them away from their daily duties.
To enable us to provide you with a timely response, and in accordance with
our obligations under section 17B of the LGOIMA, we wish to clarify if
there is anything particular you require. If so, the Council recommends
refining your request to be for a narrower scope of information if
possible. Should the request not be refined, it is likely that the request
will be refused pursuant to section 17(f) of the LGOIMA, as the
information requested cannot be made available without substantial
collection or research. 
 
Refinements can be for a specific period of time, correspondence from an
individual or team, memos or reports, documents related to a specific
street or address, etc. 
 
To enable us to meet our obligations under the LGOIMA, we would be
grateful for your response as soon as possible, but by no later than 28
August 2025.
 
Please note, any clarification or amendment of a request is considered to
be a new request for the purpose of calculating the maximum statutory
timeframe for response—see section 13(7) of the LGOIMA.

Kia ora Asha,

Thank you for your time. I’ll aim to keep this request as straightforward
as possible.

This relates to planning commentary made by Council officers in relation
to resource consents within Long Gully, where draconian development
constraints are partly justified by claims regarding road capacity.

These claims lack substantiated evidence and have been contradicted by
independent traffic engineering reports that provide quantified
assessments.

Despite this, the Council continues to raise issue in general regarding
the road.

To better understand whether the conditions of Hawkins Hill are
particular, compared to other Right of Way (RoW) arrangements, we are
requesting a list of all RoWs managed by the Parks team.

Once the RoWs are identified, by name or similar, we intend to follow up
with requests for further details including:
a) the number of dwellings served by each,
b) any documented assessments of their capacity, and
c) actual traffic volumes where available.

We trust that narrowing the scope to just Parks-managed RoWs will make the
initial request more relevant as well as achievable to fulfil.
