I am writing to formally request information under the Official Information Act 1982 regarding the procurement processes for school uniforms, stationery, and other school supplies at Wigram Primary School.
It appears that the school uniform, for example, can only be bought onsite at the school office. This information is being sought to understand how the school ensures its compliance with the Commerce Act 1986 in its agreements with suppliers, particularly regarding exclusive arrangements for uniforms and supplies.
Specifically, I am requesting the following information:
1. Procurement Process
a) A copy of the most recent tendering or procurement process for school uniforms and supplies, including any documentation outlining how suppliers were selected (e.g., tender documents, contracts, selection criteria).
b) Whether competitive tenders were conducted for exclusive supplier arrangements, and if so, how often (e.g., within the last three years).
2. Exclusive Supplier Agreements
a) Details of any exclusive agreements currently in place for the supply of school uniforms, stationery, and/or other school supplies.
b) The duration of these exclusive agreements and whether there are plans for them to be renewed or amended.
c) Information on how the school ensures that any exclusive arrangements are competitive, transparent, and in compliance with the Commerce Act’s requirement to not substantially lessen competition.
3. Financial Benefits and Impact on Parents
a) Any financial benefits (e.g., rebates, sponsorships, gifts) the school receives as part of these exclusive arrangements, including details on how these benefits are used by the school.
b) The steps taken by the school to ensure that these arrangements result in the best possible prices and quality for parents and students.
c) Any information provided to parents about the procurement process, including the reasons for exclusive arrangements, the terms of those agreements, and any financial benefits received by the school.
4. Consultation with the School Community
a) Evidence of consultation with the school community regarding these agreements, particularly with parents, including how their feedback was taken into account in the selection of suppliers.

1. Procurement Process
a) A copy of the most recent tendering or procurement process for school
uniforms and supplies, including any documentation outlining how suppliers
were selected (e.g., tender documents, contracts, selection criteria).
b) Whether competitive tenders were conducted for exclusive supplier
arrangements, and if so, how often (e.g., within the last three years).
In 2017 the school went through a change of name for 2018, and change of
site in 2019.
The Board of Trustees nominated a Board member and interested parents to
look at options for a new uniform to begin introduction in 2018 along with
the change of school name.
Various local school uniform suppliers provided options for school
uniforms, along with pricing.
Our current 2 suppliers were the two that we chose to go with for one of
the following reasons
1. A much cheaper product, yet still quality fabric. However it would
mean we would have to hold our own stock as they do not sell directly to
the public.
2. An item that the first supplier does not stock and is sourced
locally by a commercial provider of school uniform. We just order in the
sizes we want to complete our selection of uniform.
Documents relating to the whole 2017 process are no longer kept as it is
beyond the 7 years required.
b. We have no specific agreement to either supplier and just order as
we require. Going from our current price list, our uniform is
significantly cheaper than most schools because we purchase directly from
the supplier. Due to these cheaper prices, and having no issue with the
supplier, we have not changed our system.
2. Exclusive Supplier Agreements
a) Details of any exclusive agreements currently in place for the supply
of school uniforms, stationery, and/or other school supplies.
We have no exclusive agreements in place with retailers for the supply of
uniform, stationery or other school supplies. For supplies we shop around
for the best pricing, for stationery we offer one option for outside
purchase, but parents are free to purchase their stationery from any
provider.
b) The duration of these exclusive agreements and whether there are plans
for them to be renewed or amended.
We do not hold any agreements for the supply of uniform, stationery or
other school supplies.
c) Information on how the school ensures that any exclusive arrangements
are competitive, transparent, and in compliance with the Commerce Act’s
requirement to not substantially lessen competition.
We constantly internally review the uniform products – prices/quality and
availability, to make sure our parents are getting the best value for
money. Some of our items (with no logo), parents whose to purchase from
retail stores. There is no issue with this.
3. Financial Benefits and Impact on Parents
a) Any financial benefits (e.g., rebates, sponsorships, gifts) the school
receives as part of these exclusive arrangements, including details on how
these benefits are used by the school.
We do not receive any benefits from our providers. Parents get the
benefit of cheaper than retail uniform for some items.
b) The steps taken by the school to ensure that these arrangements result
in the best possible prices and quality for parents and students.
This is the very reason we do what we do for our uniform. Parents can
shop around for stationery if they choose, and we shop around when
purchasing any school items.
c) Any information provided to parents about the procurement process,
including the reasons for exclusive arrangements, the terms of those
agreements, and any financial benefits received by the school.
As we do not receive financial benefits we do not provide any information
to parents.
4. Consultation with the School Community
a) Evidence of consultation with the school community regarding these
agreements, particularly with parents, including how their feedback was
taken into account in the selection of suppliers.
There has not been any consultation with parents regarding uniform since
2017. Each new Board of Trustees may choose to do so if they feel this is
in the best interests of the school community.
We would love not to be the sole supplier of uniform, but it has been put
in place as this is a saving to all families in the school. We would love
to direct parents to an outside retailer for all uniform, but the cost
savings for parents is just too great.
