Dear BUS: IRO,

Thanks Deborah, I don't accept this response. The website clearly states that a business case has been developed and approved. Past requests have seen business cases released on that basis. It appears that this request is not being treated in the same way others have.

"A regional detailed business case was approved on 27 February 2015. This provides a regional view of the benefits and costs of shared ICT infrastructure services."

I'm asking that you reconsider releasing that business case otherwise I will be lodging a formal complaint.

If you can let me know by Friday COB, 29th May 2015, next week what the Council response is.

Thank you for your email asking that the Council review its decision to
refuse to provide a copy of the regional detailed business case for SIIP.

 

The decision making process to withhold ( or release) information is made
under the Local Government Official Information and Meetings Act 1987 and
importantly, on the specifics of each request and at the time of that
request.

 

The decision on your request was not made on the basis of what has been
posted on the Council’s website. While the Council updates project
milestones, that does not automatically mean that all information is
publically available.

 

As advised in the response, the Council is undergoing due diligence and
the regional detailed business case is the first gate in that process. If
the response has not been clear in that respect you may wish to speak with
the project lead. Let me know if you wish to do that and I can put you in
contact with the officer.

 

I reiterate, if you disagree with the Council’s decision you can make a
formal complaint to the Office of the Ombudsman.

I note the WCC has not informed you of the grounds under LGOIMA that they are applying as the reason to refuse you the information. You could ask them to specify this as they are required to give you specific grounds.

I wonder if it is just better to jump to the complaints process. On the basis that they have supplied this information before and haven't this time.

There's nothing stopping you both complaining to the Ombudsmen and continuing to pursue the request through the council.

They did identify the reasons - LGOIMA 7(2)(b)(ii) "the making available of the information would be likely unreasonably to prejudice the commercial position of the person who supplied or who is the subject of the information",
7(2)(h) "enable any local authority holding the information to carry out, without prejudice or disadvantage, commercial activities", and
7(2)(i) "enable any local authority holding the information to carry on, without prejudice or disadvantage, negotiations (including commercial and industrial negotiations)".

It seems highly dubious that the entirety of the document is covered by those reasons. You could request that they release the document redacting where appropriate, and identifying the reasons.

It also seems to me that most of those reasons would evaporate once negotiations are concluded, so we could then request the document again and the honesty of the redactions should become apparent.

I also wonder if the council is following best practice in their business case and procurement processes (e.g. Treasury guidance at http://treasury.govt.nz/statesector/inve... or MBIE guidance at http://www.business.govt.nz/procurement/...). That could be something to ask in a new request.
