Dear AT Official Information (AT),

This request is for AUCKLAND TRANSPORT. It has nothing to do with Auckland Council. The years for which I request information on Kms treated, the total chemicals used and the costs invoiced were for the years BEFORE these functions were transferred to Auckland Council.

I require that this request is returned immediately for AUCKLAND TRANSPORT response by the original 20 working days of 3 September 2020

Yours sincerely,

Thank you for your email.

You are correct, this function used to be with AT. However, in March 2019 this function was taken over by Auckland Council and all historic notes were transferred to Council.

Auckland Council have accepted the transfer of your request and they will respond to you directly.

Dear Hana,

Further to our acknowledgement on 11 August 2020, we require more time to
respond to your request.

We are currently still collating and processing information for your
request. Therefore, Auckland Council is extending the time limit for
responding to your request under section 14 of the Local Government
Official Information and Meetings Act 1987 (LGOIMA). We will reply to your
request by 22 September 2020. Please note this is a maximum response time
and we will endeavour to respond sooner.

The reason for this extension is:

o Consultations necessary to make a decision on the request are ongoing
and a proper response to the request cannot reasonably be made within
the original time limit.

Please note you have the right to request a review of this extension from
the Ombudsman.

If you have any questions please let me know.

I would be grateful if you could PLEASE respond BEFORE the final day. I have already missed an important meeting that this information was required for. You always note that this is the "maximum response time" and you will "endeavour to respond sooner" but I have yet to receive an OIA response that did not arrive on the final day. This is really not good enough. This is now urgent.

Dear Official Information,

I asked the following question about annual totals of chemicals:

"3.the annual totals of the following chemicals (as active ingredient) used in each area for your weed and vegetation control: glyphosate, metsulfuran methyl (meturon), organosilicone, diethanol condensate (fatty acid) & any other significant chemical."

You informed me on September 9th that this information I had requested ... "is being collated to be published later this year.We are therefore refusing this part of your request under section 17(d) of the LGOIMA on the basis that the information will soon be publicly available."

I have yet to receive this information, nor pointed to any publication containing it. Would you please supply this as a matter of urgency.

Dear Hana,

Thank you for your email.

At the time of your request we understood a report was being produced and
would be made publicly available. Unfortunately that is no longer the
case.  We do not hold the information you have requested in the format you
have requested.   To locate and collate the information from the various
sources where it is held would take a significant amount of time and would
prevent us from being able to carry out our day to day work. Therefore, we
are unable to provide you with this information under section 17(f) Local
Government Official Information and Meetings Act 1987 as the information
requested cannot be made available without substantial collation or
research.

However,  the council has instead published information (link below),

Your response is totally unsatisfactory. The requested information is/was held by Auckland Transport. When this request was transferred to Auckland Council I was informed in this FYI request that ... "this function used to be with AT. However, in March 2019 this function was taken over by Auckland Council and all historic notes were transferred to Council."

As "all historic notes" were transferred to yourselves, the information should be immediately accessible and would NOT take "a significant amount of time" to collate and supply.

Dear Official Information,

Thank you for your prompt response. This letter is a copy of your September 9 2020 letter, which was not your "final response letter" as you updated it on December 17 2020. (see above FYI responses)

Your December 17 2020 letter said that "at the time of your request we understood a report was being produced and would be made publicly available. Unfortunately that is no longer the case".

You further responded by saying that this information - (which I presume was going to be the subject of this "Report") - "cannot be made available without substantial collation or research." I queried this response on 4 January 2021 pointing out that this information WAS held by Auckland Transport in a readily accessible format.

Would you please clarify if this September 9 2020 letter has been sent to me in error, or it is your exceedingly discourteous way of refusing to supply the information and telling me to get lost ?

Yours sincerely,

Hana Blackmore
