The Bay of Plenty Emergency Management Group (BPEMG) played a significant role in the management of the response to the disaster that occurred on White Is/Whakaari on Dec 19th 2019. Under a previous OIA request, BOPEMG advised that:
“The Bay of Plenty Civil Defence Emergency Management Group was the lead
agency for the Whakaari/ White Island Eruption. The response was
controlled by the Bay of Plenty CDEM Group Controller, this involved
coordinating with New Zealand Police who lead (sic) the rescue and recovery part
of the response”.
In accordance with best practice BOPEMG will have undertaken a formal debrief, review and report of their response to the disaster and identified any action items or other learnings from the incident and their coordination role under the CIMS model.
Under the provisions of the OIA and through your office, I request a copy of the formal report arising from this review.

Response to OIA Request(s)
Thank you for your response to my OIA Request seeking further clarification on the matters of “Lead Agency” for the Whakaari/White Island response and of the IMT established at the Whakatane EOC and my later request for a copy of your formal review of .this incident. These two OIA requests have somehow got merged under this one title as a result of the transfer from Whakatane DC.
1. The request for information around the Lead Agency Role
I have had some difficulties understanding your response to the requested information and would like to set out my understanding. I am using the information gathered to support my call for a formal and independent inquiry into the response and I am making every effort to ensure that I have the correct information. Please note that my concerns are in regard to the ongoing failings in the design and application Coordinated Incident Management System (CIMS). I have no views on the specifics of the Whakaari response itself.
a. You have advised that BOP CD&EM Group was the Lead Agency and provided “control”. I note that the CIMS model (under which the Lead Agency operates) has two elements. The first is “Control” which operates horizontally across the management model and the second is “Command” which operates vertically. These comprise the “Coordination” component of the CIMS model and you can’t have one without the other (ref 2.6 CIMS manual).
b. You have advised that NZ Police were “operational lead Agency”. In communications with Police they have been adamant that they were not the led agency and that they “facilitated the search, rescue and recovery phase of the Whakaari/White Island operation in support of the lead agency (BOPEMG)”. Ref letter from Police 13 May 2020.
c. You advised that NZ Police “was the operational lead agency for coordinating recovery and reconciliation as set out in section 41 of the National Civil Defence Emergency Management Plan, Order 2015”. Section 41 sets out the role of the New Zealand Police during the response to and recovery from and emergency and makes no comment on the lead agency function. Section 41 makes not statements about NZ Police operating as a lead agency.
d. You advised that the IAPs supported that Police operated as lead agency. The issue is however, regardless of what the IAPs stated, Police do not accept that they were ever the lead agency.
I will include your response in my submissions re a formal inquiry but will note the above inconsistencies in the advice given.
2. The request for a copy of the formal review of the incident. Your advice that this has been denied is noted.
