What legal advice was given to Peter Hughes concerning disciplinary action commensurate with the Secretary of the Treasury's failure to "act reasonably."

Dear State Services Commission,

I request any records, including email, memos and phone transcripts, of legal advice given to Peter Hughes, provided either internally or externally, that suggest disciplinary action (including dismissal) that could be taken by the State Services Commissioner against Gabriel Makhlouf that would be commensurate with the findings concerning Mr. Makhlouf's conduct as established in the June 2019 investigation by John Ombler.

In particular, I want to know what courses of disciplinary action the Commissioner had available to him concerning Mr. Makhlouf, upon receiving the results of Mr. Ombler's investigation.

Was there a legal opinion provided to Mr Hughes that Mr. Makhlouf's failure to "act reasonably" in relation to the leak of budget information from Treasury in May warranted disciplinary measures?

I'm pretty sure that Kate is a Kiwi freelance journalist writing for the Irish Times. I worry that, if SSC thinks that Kate is an Irish-based reporter who is not a Kiwi national, they might wait 20 days before telling her that her request will not be fulfilled or that they need confirmation of her eligibility, and take that as excuse to push out the deadline. I suggest that Kate make clear that she is a NZ citizen or resident in the request to avoid that happening.
