Thank you for your email querying the Legality of parking vehicles on
roads for sale. 

 

There is a Hasting District council by-law under the Parking Offences
heading that reads;

 

Display a 'for sale' sign on a vehicle parked on a road or public place

 

Please find attached a link to the Hastings District Council Consolidated
Bylaw document.

Thanks for your quick response.
As per the bylaw, It is not allowed to park vehicles on road for the purpose of sale by putting 'for sale' sign.

Could you please confirm, (i) what are the penalties for parking vehicles on road with 'for sale' sign and how these are enforced?
(ii) How many infringement notices are given to the offenders for the year 2018 and how much money Hastings District Council has received from these penalties, please provide monthly data.

January 2019 regarding ‘For Sale’ parked vehicles infringement notices.

 

2.    This is being treated as an Official Information request, and as
such Council must meet certain criteria in how and when we respond to you,
set out in the Local Government Official Information and Meetings Act
1987.

 

3.    Your request has been provided to the relevant officers for follow
up. You will be advised of Council’s decision as soon as is reasonably
possible, and no later than 20 working days from the date we received your
request, unless we have informed you that we need an extension to that

Local Government Official Information and Meetings Act Request – ‘For
Sale’ Parked Vehicles Infringement Notices – Response

 

1.    Further to your request for information received 16 January 2019
regarding ‘For Sale’ parked vehicles infringement notices, I am now able
to provide you with Hastings District Council’s response.

 

2.    You requested:

                      Could you please confirm, 

                      (i) what are the penalties for parking vehicles on
road with 'for sale' sign and how these are enforced?

                      (ii) How many infringement notices are given to the
offenders for the year 2018 and how much money Hastings District Council
has received from these penalties, please provide monthly data.

 

3.    Response:

 

(i)            As per Hastings District Council’s Consolidated Bylaw,
section 5.4 Parking Offences –

5.4.1  A person must not:

k) Display a ‘for sale’ sign on a vehicle parked on a road or public
place.

 

The penalty is $40.00, initially a warning notice is given followed by an
infringement.

 

(ii)           In 2018 there were no infringement notices given.

the option to contact the Office of the Ombudsman to request a review. The
