Use of AIT scanners - protection of Human Rights

Jem Traylen made this Official Information request to Civil Aviation Authority of New Zealand

The request was successful.

From: Jem Traylen

Dear Civil Aviation Authority of New Zealand,

I am concerned about the introduction of AIT scanners at airports which are the source of a great deal of concern for transgender and intersex passengers. I do not recall any consultation by CAA/AvSec on this matter.

1) What consultation have you undertaken with transgender and intersex people?
2) What checks have you undertaken to ensure compliance with the Human Rights Act?
3) Please provide a copy of all relevant operating policies.
4) What training have you provided to staff regarding transgender and intersex passengers?
5) Please provide a copy of any significant reports on the trial at Wellington airport.

I trust that this request is reasonably straightforward and would be happy to clarify if necessary.

Yours faithfully,

Mx Jem Traylen

Hello Jem,

Please find attached the response to your OIA request.

You will see that as part of our response we have included a report on the AIT trial that Avsec undertook. Please note that we have made the decision to release to you the two appendices that form part of the report (subject to reductions made in relation to information we have decided to withhold under section 6(c) of the Official Information Act). However, due to technological difficulties we are unable to provide these appendices to you today. We will endeavour to send these to you in the next 48 hours. Please accept our apologies for this.

Good afternoon Jem,

Following up from my previous e-mail, please find attached AIT trial report including Appendix 1, Appendix 2, and Appendix 3. Appendix 4 has been withheld.

The redacted text and Appendix 4 have been withheld under section 6(a) of the Official Information Act as releasing that information is likely to prejudice the security of New Zealand. Apologies, but the correspondence I sent on Tuesday incorrectly referred to section 6(c) - it should have referred to section 6(a).

As per my previous correspondence, you have the right to make a complaint to the Ombudsman to seek an investigation and review of our decision. The Ombudsman’s contact details are:
