Good morning Richard

Thank you for your email dated 2 July 2018 requesting information under the Local Government Official Information and Meetings Act 1987. Your request for information is granted.

1. You have requested a copy of the Wellington City Councils' policy regarding enforcement of properly sign-posted Residential Parking Areas.

I have attached a copy of the WCC Parking Policy dated September 2007, which is currently under review. The Residents parking scheme is on pages 11-13.
Legislation, set by Central Government, governs parking enforcement of offences not Local Authority Policies.

2. The Legislation that applies to Residents parking areas can found in the Land Transport (Road User) Rule 2004, Rule 6.4 - Parking contrary to notice, traffic sign, or marking:

(1) A driver or person in charge of a vehicle must not stop, stand or park the vehicle on any part of a road contrary to the terms of a notice, traffic sign, or marking that -
(a) indicates that stopping, standing or parking vehicles is prohibited, limited or restricted; and
(b) is on or adjacent to the road; and
(c) is authorised by a road controlling authority under the Land Transport Rule: Traffic Control Devices 2004.

Infringements that could be issued within a Residents parking area would, depending on circumstances, consist of:

Parked in a Residents only park without displaying a valid permit .
Expired License label.
Expired warrant of fitness.
Expired Certificate of fitness.
Parked facing the wrong direction.
Parked on a footpath.
Parked on an area marked by broken yellow lines.
Parked within 1 meter of a vehicle entrance.
Parked so as to obstruct a vehicle entrance.
Not parked within the white lines indicating a parking space.

The main offence in regards to Residents Parking Areas is the first bullet point above. I have attached the applicable page from the Parking Officers "Parking and Enforcement Guidelines".
