Thank you for your advice that CMDHB has decided to extend the timeframe within which a decision is to be made on this request.
If I understand the reason correctly, it is twofold:
1) CMDHB is continuing to locate information that may be relevant to this request.
2) That consultation may be required with regard to some of the information that may form part of CMDHB's response.
I am unclear as to what is intended with regard to letting CMDHB employees have access to this information prior to requestors. This is not a valid reason within the OIA for timeframes to be extended. If you intend for those staff to be consulted prior to making a decision on the information, that would be quite proper; however, the inclusion of this statement has somewhat confused me as to its intent. Would you mind clarifying this point for me?

Good afternoon
Thank you for the feedback, when we previously released information on our
facilities to Radio NZ, many of our staff were distressed to hear of the
information affecting their workplace and facilities for the first time
via media reports. As noted in the letter, we have received a range of
related requests, some dealing with the status of facilities, and others
to do with reports and communication on these matters.
The reasons for our need of an extension are outlined in the 2^nd
paragraph of the letter, and include the volume of requests, and the scope
of material to be retrieved. However, in the 4^th paragraph we are simply
advising all current requesters of our intention to also share the
information with our staff - we do not expect this to affect the collation
and release processes underway.
I hope this clarifies the circumstances, please let me know any further
concerns.

Thank you for your prompt reply. I can understand that there could be internal communication concerns regarding these matters.
With regard to the number of requests being managed on this topic, while understandable that it would increase workloads for those responding, this is a managerial issue and does not allow for timeframes on decisions to be extended under the OIA.
Of course, the need to collate and consider information, especially if consultation is required prior to a decision being made, may mean the statutory 20 day timeframe may need to be extended for a reasonable time to allow such undertakings to be completed.
If the information in question has not been retained by CMDHB in such a manner as to ensure its timely access (e.g. held on personalle files of former employees similar electronic drives/files) then this may not meet the test for requiring a timeframe extension.
From what advice has been on this matter, it does seem as though a further 20 working days is excessive in order to consider and decide on the information requested.

Thank you for notification of a reply, of sorts, to my Official Information Act request. The scope of the request was not conveyed at any time prior to have been a cause for administrative concern, so it was surprising to read that the DHB had had difficulty compiling information to satisfy the request.
In reply, I would like to draw your attention to the part of my original request which stipulated information going to the Minister of Health and the Ministry. These are of course two separate entities, however, it does look as though the DHB has treated them as one.
Additionally, the manner in which the DHB is looking to make information available seems to be obfuscating the DHB's responsibilities under the OIA. It would be concerning to me if this is the intent of this style of reply. It is not up to the individual making the inquiry to sort through vast amounts of information to see whether the information requested has been supplied. It is up to the responding agency to ensure that its records have been examined and relevant information located and supplied in such a manner as to ensure the request is addressed.
I have not made an exhaustive search of the information supplied; however, it does not look as though information categorized as emails and\or memorandum is included within the information supplied via the link. Additionally, having a time restricted electronic link to access the information is not within the scope of providing an answer to an OIA request. Such a time limit could again be seen as attempting to obfuscate the DHB's responsibilities as an agency with legislated requirements under the OIA.
I am prepared to wait an additional 5 working days so as the information compiled in response to my request can be collated and provided in a single reply.
